Topic: Need some advice on filing out the Foregin tax credit relief form (SA106)  (Read 1588 times)

I am in the process of filing out the SA106 form ( the foregin tax credit relief).
For taxes paid in the US can I claim Fica and medicare tax with the Federal incomeTax)

I am not clear on why you are claiming credit for US taxes.

Did you have a UK employer?  If so any UK source income would have been resourced as foreign on the US tax return so that you would not have any doubly-taxed income in the UK.  What kind of income are you claiming foreign tax credits in the UK?

Husband was on work visa at the time and was living in US.  He still has to do the tax return here... and they told us to fill out the foregin tax SA106 form. He had no UK income at the time.  He just has had to do uk tax returns for the last 5 years because of property he owned in the uk at the time and now they are insisting he do them this year 04-05

I just need to know if I can put all taxes he paid in the us including fica and medicare?

No - if he was not UK resident then he only declares UK source income (eg rental income).  For 2004/05 he would claim the split-year concession.  You could visit a local tax office for help if unclear.

We have been twice to the inland revenue and they said they "think" we need to fill out this foregin tax credit form.. The girl at the Inland revenue said we may not need to do it? 

Kinda scary when a girl who has been working for the tax office thinks we might need to do the form.  What happened to a clear cut answer.

She said once I read the forms then it would give me  clue as to weather I need to fill in this form. 

I called the IR and the guy on the phone said I need to show what funds were made in us and fill out the foregin tax form.
according to the non residents form he was a not a resident or oridinarily resident.

geez what to do... these forms are sometimes wordy and the wording is not so clear at times.....

Not that I am more then an expert as guya at this, what he says makes sense from what I understand, only UK source income would be taxed in the UK when not resident.

I think this forum shows that government people don't often even know their own policies and procedures well.  Again, the best thing to do is get tax advice from a chartered accountant who is experienced in UK exptratirates working in the US.

I spoke with an inspector and they said exactly what guya said finally someone who has an answer that makes sense!
