Hi
I am new to this site. I have a question regarding taxes. I am going to start process for my family and I to move to the U.S. I am a dual U.K/U.S citizen. I have not filed tax returns and I know I need last three years for my husband's visa process. Can anyone tell me which forms I need to file? I make on average about £15,000 per year. I also have been married for two years, so can I still file as single or do I need to file as married? I do not and never had over $10000 in any account(s) at one period of time.

You say "family", so I'm presuming you have kids.

File a 1040, form 2555-EZ, and form 1116.  If you have kids, you're entitled to child tax credit.  Any year you have child tax credit, you may save money by filing just Form 1040 and 1116, and NOT filing the 2555-EZ.  all the forms and instructions are on www.irs.gov

You file as single when you are single, Married filing separate when you are married with no kids, and for years when you had kids, you may be able to file as Head of Household.  You can file as Head of Household when your husband is an NRA and you provide 1/2 or more of the financial support to the household.   

The easiest way to do this is to buy tax software from E-bay or a tax software website.  TurboTax is a good programme.  The programme guides you through the whole process and ensures you get your taxes done right.

Question: Can you file retroactively? I don't think I've filed for two years. If you can, do you just use the 2006 forms? What should I do?

That's correct I do have children. I will have a look for the software you mentioned also. I know I can download those previous years forms from the IRS website.

Old years are done one of three ways:

Paper returns can be found on www.irs.gov for past years, along with the past year instructions.
TurboTax (and other popular tax programmes) sell past years online at their websites.
Tax preparers who specialize in US/UK tax prep have all back years available and can help you prepare your return.
