Sad but true... no in order to guarantee a return to the USA you must become a citizen or go through it all again...

Isn't that the same here though? If I don't get citizenship and go back to the US for a while, won't my ILR expire after a certain amount of time?

Yes... which is in part one of the reasons I am getting mine here in the UK... the thought of all this again just drives me nuts... and we do plan on returning one day...

I keep kicking myself for not staying in the US the extra year or so it would have taken so as to not go through this whole US immigration thing again...The long term expense and headache could have been saved.

How many years can you be out of the UK without having to jump thru the hoops again?

I think with ILR its two years that you can be out of the UK. Hopefully someone else can confirm.

That is exactly why I got my UK citizenship, I wanted the paperwork to be settled on one side because its beyond a pain and you never know whether you will move back (which is something that we are not ruling out).

You're right. To retain ILR, one cannot be out of the UK for more than 2 years, and you will be classed as a returning resident if you return before a two year absence:

That's right Tam we lived in the US for 3.5 years before moving here... so we need his record for the US state as well... DH is a former green card holder.

If you check on DIA or visajourney or BritishExpats I think you'll find that you don't actually need the US record.

That's okay... I don't mind having excess info... I always have excess info... I got it while in the USA just in case... I've dealt with immigration officials who did not know what they were doing, so the more paperwork I have to throw at them the better I feel. 

But for everyone else, your right you don't need a certificate from the USA if you are a former Greencard holder.  :) It's on the US embassy website and USCIS websites as well.

FYI for anyone requesting the police report/background check. It takes 40 days. When I sent in the form I received a letter back on 12th June saying that they had received it and that the processing can take 40 days. Since today is 17th July I was a bit concerned it may have been lost in the post so I called and I was told that they are sent out on the "36th" day (which is today for us) so we should receive it within the next couple of days.

They send on the "36th" day?? Weird!  ::) It wasn't that way when I did this 3 yrs ago, got it back within two weeks.

Anyway, just wanted to give the heads up for planning purposes.

Do they go by business days or no?  And, do they go by from the day they sent you the confirmation of the receipt of payment?  I'm trying to figure out where we are in the process.
