Great news, Jules. What a relief!




Thanks again all!  :) It is still a big relief for us tonight!

We are going back next month for a visit and my husband feels so much better about it now. He had worries that he would be detained for hours and then sent back because of the *bleep* up.

That said, I am going to bring my letter with the evidence that I sent to the Embassy last week (recorded via the post) just in case there is a problem.

If you go for a visit this month, won't it mean that your husband can't re-enter the U.S. for another three months, or does the visa change that? Regular U.S. law requires noncitizens who have visited and left the country to wait three months before they can re-enter.

I have never heard of that Suzanne. Anyone that is eligible for the visa wavier program can stay for 90 days or less or visit more than once without having to wait another three months everytime to re-enter. Example - if someone went for a two week visit and then left, they don't have to wait for another three months to go back for another visit. Unless it some new rule that I don't know about?

When we get DH's settlement visa, once its activated he will have a green card and can come and go but not be out of the US for more than one year. That said, I think we have seen stories of people being out of the country for say six months and they get questioned.

I don't there's a rule about not coming back for 3 months -at least I've never heard of one. Most academics use the visa waiver program/visitor's visa to travel to the US for regular conferences and if this rule applied, they wouldn't be able to do their jobs properly. My MSc course tutor is British, but has also been employed by a US university during the last 7 years and still has PhD students in the US. So far this year, he has entered the US on the visa waiver 4 times (in February, March, May and July) and will be travelling back again in December - that's 5 visits within 11 months, with just a few weeks between each one.

I'm just speaking from my experience with my brother and a wannabe American citizen (he was the only one in the family who couldn't see that she didn't love him and was using him). She'd stay for three months, then go back to Germany, stay three months, then go back to Germany. Customs got so suspicious that they thought she was a drug smuggler and held her for a day. My brother got her a brief fiance visa, but thank God he realized that his family and friends hated her for a reaon. (She was six feet, 10 inches tall, and had close to model looks). But she talked to my brother as if he was a slave one time, and we almost had a catfight. She told me, "I'm going to get you out of Andy's life." And I said, "Not before I see your ass go back to Germany with no engagement ring." My brother made good money, and last that he knew (he's now married to someone different), she was dating a rich Asian guy.

Jules, what a palaver. So much for fail-proof security from the good ole US gov't. I hope the visa is issued soon!
