Looking for advice: Moving Stateside
« on: September 03, 2007, 09:13:54 PM »
Hello,

My husband and I are looking at moving back to the states...he's English, I'm a Yankee girl and we're really confused about where to start. The logistics of it seem to be a bit overwhelming.

I've read up on how to apply for his visa and the I-90, but I'm unsure of how the process works. At what point do we apply for the visa? How does it work with getting jobs in the US? Can he even start applying for jobs before he gets the visa sorted out? Or does he need to wait until we get over there? How do I prove I can financial support him in the states if we both live and work here?

Lots of questions like that. Are there immigration advisors in the UK who can give you advice on moving to the States?

Any help would be greatly appreciated.

Thanks,

Kelli

Firstly, you'll have to file an I-130 for him - forget about the I-90, that is not relevant at any stage of the spousal visa process.

As to where you will file will depend on whether or not you are eligible to use the DHS office at the US Embassy.

If you can file in the UK it will take much less time than if you are only able to file through one of the service centres in the US.

There are several sites which are aimed towards those wishing to obtain a US spousal/fiance(e) visa:

diveintoamerica.com
visajourney.com
britishexpats.com

There you will find others in the same or similar situations to yourselves.

You will also want to bookmark the US Embassy site and the USCIS site.

If you have been married for two years or more you can do DCF through the US Embassy and not go through a US service center. This is what we did for DH "green card". Go to www.diveintoamerica.com for any help.
Never say good bye with tears....just say see ya later with a smile........

Whether or not you are eligible to file your application by DCF depends on how long you've been resident in the UK, not how long you've been married.
