Changing maiden name after marriage
« on: January 31, 2008, 09:15:10 PM »
I am a American living the UK and married to a Brit, we have been married for over a year and I finally decided to change my surname to his. Question is how do I go about that I know I have to go through Deed Poll, but do I also have to pay a visit to the U.S. Embassy? Any help will be appreciated
be curious

If you are changing your name by marriage you do not need to do a deed poll as your marriage certificate suffices as evidence.

something that i never fully understood throughout the last thread-

to change your name in the UK to other than the "standard"
firstname middlename hislastname
(such as firstname middlename maidennameas2ndmiddle hislastname)

do you need a UK dead poll?  and if so, would a deed poll work in the US as well, or would you need a stationary declaraction?

Yes if you're doing more than changing your last name to his you need a deed poll because marriage is not the mechanism for changing your first r middle names.  I don't know if a UK deed poll is recognised in the US, it may differ from one state to another.

just lookat the us embassy in london website- and to change your passport you need a statatory decree.

question- there are sites online that will send you a form already filled in.  they say you'll then need to find a solicitor to witness/sign off on it.  is that hard to do?  will the solicotrs only sign/witness if they draftd the statitory decree?

It's really up to the solicitor and it depends how the document is worded. As long as it's properly worded it shouldn't be a problem. CAB may be able to help you draft something also.

Actually, anyone can draft the declaration.  I got the ones I needed for my sons certified at the Magistrate's court for £8 each (this was in 2003).

thanks- a simpel websearch showed a couple of templates.

did you need an appointment at your local magistrates court? £8 sounds like a deal.

I hope I didn't imply otherwise. Anyone can draft it, but you need to be sure it's worded correectly and has the effect you intend it to have, but the solicitor or whoever signs it for you should check that anyway.

The minute I hit "post" I realised I shouldn't have typed "actually" - I wasn't implying that you implied anything different!  ;)

I called the Magistrate's court and was given a time to go round.

myfirst mymiddle mylast
to
myfirst mymiddle mylast hislast OR myfirst mymiddle hislast OR myfirst mylast hislast.

(edit to say- if i've made any mistakes or not been clear, pls let me know and i'll change)
