Working for UK firm living in the US
« on: February 28, 2008, 09:35:44 PM »
We plan to move from the UK to the US soon.

Hypothetical question:

If my UK company wanted to keep me on as a teleworker, what would be the story as per taxation?

That is to say, would I continue to be paid in the UK, pay income tax and NI, and that's it?  And just file with the IRS using form 2555 for foreign-earned income exclusion?

I take it there's no way to get out of paying UK tax and NI and just have the IRS tax the amount instead (hopefully less!).

If you are no longer resident in the UK there is no UK tax payable (assuming zero UK workdays).  The income is no longr foreign so would all be taxable in the US.

There may be UK NIC for up to 5 years.

Separately the company will need corporate advice to ensure you do not become a permanent establishment of the UK entity in the US.  The company would have to investigate local employment law, legal/regulatory rules in the State where you would be working, transfer pricing and possibly branch profits tax issues.

Interesting, thanks Guya.

A slightly different scenario now seems more likely:

I would be in the US on a 10-year green card
Set up my own IT consulting company ("sole trader")
A UK company pays for me to remotely administer the networks of thier UK customers
This would be ad-hoc work, at a daily or half-daily rate (no "salary" as such)
I would be paid either via BACS into a UK bank account, or paid via Paypal into US Paypal account.

Presumably that scenario would be different?
