Quick update:

I had mediation today it went terrible, the mediator didn't even focus on the move, she kept triying to get us to modify or current custody order. ???

Oh, and when I told her that I was moving in a year because my and my boyfriend are getting married next year, she said, "A year is so far, you guys could break up by then." I'm sure you all know my feelings about that comment  >:(

I basically left the court house feeling emotionally drained, and stressed out!!!  :-[

I can only imagine how fun court is going to be, but I'm going to continue to stay positve.

Thank you for the update Danielle, I was going to post to ask how things had gone. I'm sorry things didn't go well today.  :( Hopefully court will be more productive than the mediation has been. Best of luck, hang in there.  *hugs*

It's not definite...but I talked to my lawyer yesterday and she said that Nelson has passed his deadline to file a response for the paperwork he was served. And she said he obviously doesn't have a lawyer, she hasn't heard from anyone. BUT she said he still has a week to obtain one (we have court on Tuesday). BUT she also said since he hasn't responded, she's going to ask the judge to disregard any of his request that he makes in court because he did not respond properly. :) Doesn't mean the judge is going to say yes, but I felt good about what she said. So, as I predicted he can not afford a lawyer and will probably be representing himself. The good thing about that is, when you have a lawyer you are not allowed to address the judge unless he speaks to  you directly. Which means Nelson will get to do all of his own talking and the judge will see what a jerk he is :) Or the judge will feel sorry for him and give him an extension. (hopefully not)!!! :)

Unfortunately....no news is not necessarily good news, but it's not bad news! Basically I will have to have a child custody evalution, which is fine I'm not worried about it and the judge said that we would split the cost 40/60 (because Nelson b*tch and moaned about me moving and he should have to pay). However, Nelson and HIS (evil) WIFE filed a response to what I said...basically a bunch of lies. His wife said, "danielle has always tried to sabatoge nelson's relationship with Elijah. and, "danielle has always threatened to take Elijah away from nelson." and nelson said, "I over exaggerated" on the days he has not shown up for visiation and, "i have no real plans to move to england".

I was PISSED to say the least. But I'm over it now, I don't feel that their lies will get them very far. Besides I can prove with factual evidence everything that filed. And they can't.

So, now everything is on hold. The evaluation can take 7-8 months. Al and I were planning on getting married March and move in July. :(

BUT... it'll all be with the end results....hopefully!!!

Things will work out in the end - I just know they will.  You've got time.  And as you say, you have proof and all they have is lies.

I think the Court will be hard pressed to force you to give up custody when you've been the primary carer all his life.  But then who knows.  It's a tough decision to leave children behind, but it can be done, it can be dealt with and life marches on, you know.  I'd say wait to make that decision until it becomes necessary.
