I am new to this forum . yesterday i logged in from my workplace  maybe somebody has  taken my logged in details .i desperately need advice .i dont know who is playing prank here . I am on my break .

Why not visit the Welcome Wagon and give some background about yourself, like which state and city you are from and your connection to the UK?

You can post your refusal notice there or here afterwards and perhaps get an informed view about your reconsideration...

I am bit stressed and disappointed due to the refusal . when you  work towards something and at the end failure anyway  i am still having hopes .

My refusal .

...In View of the fact that you had 234days abscences from the uk in which amounted to 54 days over the permited 6 months abscences allowed under wp the secretary of the state is not satisfied that you have spent a continious period of 5 years in the uk in the wp category.

...You are not entitled to appeal this decision .......

... you still have leave to remain where your current conditions continues to apply ......


this is the refused notice i received  i already send for  Reconsideration .
my big mistake was when i filled in application i wrote summer holidays i used to travel every summer  paid holidays +unpaid holidays .which i have n't mention in the  form . i get 35 days annual leave as well fullypaid spread over the year 2 weeks summer 1 week easter 10 days dec christmas.( as i am a teacher ) the longest one was when i was on maternity leave i travelled which is also 2 and half when my child was 2 months  old . due to her ill health i extend my visa . anyway now i attach everything with the covering letter  as evidence paid salary slips . doctors letter etc... what i am concern is god forbids  If the result comes out to be negative  what i should do .

a.. shall i approach a solicitor or how you will going to assist me further
b.. wait and apply next year .( which i dont think is right if now they deduct my paid leave (i,e 14 days +8+14+14) i will left with 4 days .
c.what yours suggestions and advice
d. My husband already discuss with his friends and other solicitors they adviced him to withdraw and apply in fresh .some advice him to wait until next year  . somesaid reconsideration cases will result in negative only.

If the HO said you aren't entitled to an appeal, why are you asking for one?   ???

She is asking for reconsideration, which anyone who is refused without right of appeal can do.

It is worth a try, if you explain that most of the trips were work related.  However, it may not be successful.  I would suggest that you look at extending your work permit.

I think that the problem is the OP was out of the country too many days during the five year period and not for work purposes.

Not sure what the difference would be to the Home Office regarding paid or unpaid leave, really.

but i applied when they used that guidance as criteria  for  my application .  when i emailed  Ho they send me details of that guaidance.

so what do you personally think for my case

There's a zillion ANNEX F's out there.  Possibly the OP might be referring to the old ANNEX F covering ILR applications, which had qualified disclosure several years back, but a few rogue copies snuck out into the internet.

It became obsolete when the main sections were incorporated into a Statutory Instrument in 2005.  So reading it is a waste of time.  Other sections not treated by Statutory Instrument are classified, and not subject to disclosure under the FOI.  Even by appeal.  I tried and got nowhere.  The remaining sections were thrown on the skip.

But in all events, the IDI's are not statutorily provisioned, and grounding a review upon them is shakey at best; grounding an appeal on them is impossible.
