Physical presence test - just time in US counts?
« on: August 03, 2008, 09:51:47 PM »
I've filed my extensions for 2007 taxes and just need to give the word to my preparer in the US before Oct. 15. I'm trying to plan some holidays for the fall, but had a question about physical presence test.

The IRS pages for the Embassy here in London state the following:

Physical Presence test:
To meet this test you must be a U.S. citizen or resident alien who is physically present in a foreign country or countries for at least 330 full days during any period of 12 months in a row.

I'm confused because it says "...who is physically present in a foreign country or countries..."

Does this mean as long as I spend at least 330 days in a 12 month period in ANY (and/or any combination of countries EXCEPT the US) that I'm ok?  I'll have only spent 11 days in the US in the twelve month period leading up to early Oct.

If so, can I spend an unlimited number of days in other foreign countries without jeopardizing my physical presence test?

Your advice is much appreciated.
Elise

This is correct.  You are only counting the time physically present in the US.

It sounds like you should ask your accountant if you qualify for some bonus days too, as it sounds as if you will.
