Assuming that he is found liable for everything then his insurance will have to pay for everything - your car, the other guy's gate, the other car, everything.  You may have to initially pay an excess, but this will be reimbursed.

Asuming his case goes to court, you would likely only be called to give evidence if he tries to worm out of it.  Chances are he will please guilty ('no contest' would be the US equivalent I guess) therefore no formal hearing, and no need for you to be there.

Not saying it was great advice, and yes the other ladies are right...it could be considered fraudulent....so I take it back.

I have to confess I am impressed on how smooth everything has been going on. I have not had to deal with any of the police/insurance issues - just placed one phone call to the insurance company and hopefully they are taking care of everything.

I got a phone call yestarday informing me that somebody went to assess the car and that it most likely will be written off.... RIP! I'm waiting to hear the final verdict!

health wise - still aching and with terrible head & eye aches! but according to the experts is all "normal". can't stand  up because I start feeling dizzy and nauseous and overall not good!

let's see what tomorrow brings!

glad to hear yer on the mend!

Just going back to the point earlier -

People do get tempted to play up on injuries..

A road i know very well, a guy pulled out into my lane from a side road and didnt use the long run section of the road to build up speed to join the carriageway - I had nowhere to go except to crash into his back bumper at 65mph! (he must have been at like 30-35 mph at time of impact)

he gets out of his car, scruffy late 40's unkempt kinda guy and he proceeds to shout and swear and then said astonishingly 'you messed up my car so im going to have you for it' and then advanced as if he wanted to fight!!

i looked at his piece of trash 18 year old falling apart peugeot and then at my beautiful immaculate bmw and laughed! he then backed away and then looked around nervously a bit and then pretended some pain had kicked into his neck and he said 'ow i've got whiplash'

I took his number plate down and drove to the police station to report it and on the way I thought he may have been drunk..

I had no choice - it was automatically settled against me but I made sure I put in my report that my insurance company insist they check his record and get him medically checked as he was definitley didn't behave right and seemed extremely dodgy

some people really are idiots though...

I was wondering if you could do that! I know he was driving over the limit alcohol-wise, but I was wondering if he was drug tested! - well I guess it is too late now. I told my insurance company that he had been charged, but the fact that I haven't heard back from them (only from someone confirming that my ar was a write-off) I'm not sure what is going on.

I'm more "lucid" now... I think I will call the police/insurance for a follow up...
