ILR or extension to spouse visa

Hi,

My 2 year spouse visa is expiring in November 2008. The question is should I apply for ILR (form set-m) or extension to spouse visa (form flr-m). The reason for confusion is the 2 year stay in the UK requirement. My visa was stamped on 26 nov 2006 (expiring on 25th nov 2008) but I moved to the UK on 8th Jan 2007. I'll be a few months shy of the 2 year stay in the UK when my visa expires. Are they really strict on the 2 year requirement or a few months here and there is ok ?

I dont want to pay £795 for ILR when they would only issue me a 2 year extension for which I could apply directly for £395.

By the way, I have passed Life in the UK test so thats not a hurdle.

Yes, they are strict on the two years.  You will have to apply for an extension.  You are only about 2 weeks short, but it is best to do this rather than waste the money.
