Switching to a new work permit/Tier 2
« on: December 03, 2008, 09:13:20 PM »
I am currently on a work permit and considering a new job offer.  The new company is already registered sponsors.  I am nervous about turning in notice for my current job without the new work permit document for the other company.

I assume it is possible for the new employer to apply for a work permit but I wasn't sure.  Are there any other implications that I am unaware of?

The way things are, I would never recommend leaving a job until the new permit has been approved.

I have looked on the Home Office website and not seen an answer to this.  Maybe someone can help?

I have taken the new job offer and the new company has agreed to get me a new work permit before I turn in my notice at my existing company.  How will this work practically?  I will still need to work out my notice at my existing company.  When I have the new work permit, does it cancel the old?  Or will I just have two permits/visas -- both being valid?

Sorry if I am not being really clear in my answer.

I'm pretty sure the new one will void the old one.

With the Tier 2 I believe it does...the old work permit wouldn't have.

So then can I even make this work?  If I still have to work out my notice, I essentially have to finish the one job and then wait for the new Tier 2 visa afterwards.  If that for some reason is not granted, I am screwed.

Don't hand in notice until the visa is through.  If it is approved, well, you have a contractual obligation to work your notice, so do so.  The Home Office are not going to (in my opinion) have a problem with this even if you do not technically have a visa to cover the notice period.

Thanks for the replies.  I suppose I will give Tier 1 a go instead.  I qualify but given the high rejection rate, I was reluctant to go this route.

Consider a document check.  It's a much better visa.
