Can the INF 4 (Husbands, Wives and Partners) form be post-dated?
« on: December 14, 2008, 07:37:27 PM »
My partner and I are getting married in NYC on December 31 but are currently completing the INF 4 (husband, wives and partners) document in order to book her biometrics appointment so that can be taken care of in advance of the wedding.
She'll be moving to the UK around the middle of January and has a job which is due to start on January 19 so getting everything right first time is pretty important!

My question is, should the dates we supply be specific to the day on which we complete the form or to the day in early January 2009 when we take the information with our marriage license and other supporting documents to the relevant office? So in filling out the form today, should she put "married" rather than "single"? Should the time she last saw me be the last time from today (last weekend) or the last time from the date we send in all the documentation (December 27)?

We just anxious not to make any mistakes and for the form to be as accurate as possible!

You cannot submit the form.  All applications from the US must be made online via Visa4UK website.

You should not book any travel and you should submit the information until you can actually apply for the visa (which means after you are married).

Sorry, yes I do understand that all this has to be done online apart from the final step when the completed form is printed out and sent with all relevant documentation and biometrics info to the embassy.

My question really comes from the fact that you can complete the form on-line before you are married in order to get the biometrics appointment out of the way before the big day. So in effect the marriage certificate will be the last piece of documentation we need to get the Visa.

This is what was made clear when I visited an immigration lawyer in London last week but the question remains, should I be including information on the on-line INF 4 relevant to the day we will be submitting the hardcopy of the form + documentation (i.e. when we will be married) or relevant to today (when my fiancee is still technically "single").

I'm not sure I'm phrasing this as well as I should be so thanks for bearing with me...

I honestly think (and I maybe wrong, so hopefully the other "vetrens" will keep me honest) that you can't apply as a spouse until you are a spouse, ergo, until after you are married.  I realise that your fiancée wants to get her bio appointment done, but you are submitting a legally binding form at the time of application that says you are married, ergo, you can't do that until you are married.

If you submit a form that is honest based on your current situation, they simply won't issue you the visa you are looking for.

Thanks for that. I'm emailing the lawyer I spoke to last week in the hope of getting some pro bono advice on this question so if I hear back, I'll post it here.

We are in a similar situation as we want to complete the online form before the wedding so we can get a biometrics appointment as early as possible. It came up on an earlier thread and it was confirmed you can do biometric/online application before the wedding.

J-Man, thanks for the reference and if Garry and Vicky say it is true, it is true!  I will gladly stand corrected.

The very helpful lawyer I was in touch with came back with this:

"As the application will be that for a spouse, you will need to complete prospectively – though you are also required to provide details of when and where the marriage took place (state as to take place) and then the certificate will go in as confirmation with passports etc (not required for the biometrics appointment)."

So the info should be relevant to the day you intend to submit the hardcopy rather than to the day you complete the form on-line.

He also mentioned that the settlement form in question is Form VAF4 (rather than INF 4) but I gather from other threads that when you complete the application online from the States, you just fill out a generic form rather than one which is specifically VAF4 or any other.
