Questions about the Fiance Visa

Greetings everyone,

I'm from the US and my fiancee is from the UK. I'm looking to apply for the fiance visa to go and marry her, and then live, in the UK. Looking through these forums has given me some useful information. However, we're struggling to find some vital information in regards to this fiance visa. My fiancee recently met up with a solicitor who specialized in UK immigration supposedly. Unfortunately the person wasn't able to provide much information to her in regards to the fiance visa. She hopes to locate another solicitor who might be able to provide her the right information. For the meantime, we want to see if we can gather some more information here. I've listed below the questions my fiancee wanted to ask to the solicitor but couldn't.  If anyone could help us out with any of these questions, it would be most appreciated.

1. How should the evidence of relationship be presented (i.e. in a folder, in separate envelopes, etc)?  In any case, do we need any kind of written explanation as to what everything is and what it proves (e.g. “This is a log of all the calls made on Skype between X and Y, showing that we had frequent contact with each other during this period”)?

2. Does the evidence of relationship get sent in with my form or separately?  What happens with this if I submit the application online?

3. Is it true that my fiancee needs to send her evidence to me for it all to go together with mine, or does her evidence need to go separately?

4. When it comes to greetings cards etc – do they need the originals of these or can we send copies? 

If originals – how do we get these back again?

If copies – do they need to be certified?

5. Do we need to send multiple copies of our evidence?  I heard this can be helpful but I don’t really understand why or if it’s even necessary…

6. I know my fiancee needs to submit a copy of her passport, but should this be a certified copy or a notarized copy?

7. Can we marry in any venue in the UK, or is it only specific places that cater for this kind of situation?

8. Do either of us need to make any sort of appointment for an interview, or is this only relevant in the case of the Marriage Visa (if at all)?

9. Does my fiancee have to fill in any forms at all?

10. I heard my fiancee needs to write a letter about our relationship, but what information exactly do she need to write about?

11. What should the letter from my fiancee's employers say?

12. My fiancee assumes her parents will need to write a letter of consent to say they don’t mind her and I staying with them until we get our own accommodation (however long that may take) – what should this say?  Also, will someone need to come and check the size of the house?  How does she go about this?

13. With all these letters – who, and where, does my fiancee address them to?  Same question applies to the evidence of relationship, too.

14. Do we need to provide letters/statements of any kind from anyone else?

15. The vast majority of our communication is on Skype, which keeps a log of calls sent/received.  Do we need to provide the entirety of the log, or will random samples of it suffice?

16. Once I'm in the UK and we’re married, how do we go about applying for this Marriage Visa?

17. What happens if we get married and apply for the Marriage Visa within the 6 months on the Fiancé Visa, but the Marriage Visa hasn’t yet arrived by the end of the 6 months?  I ask because I heard it can take a few months for the Marriage Visa to come through…

You only need proof that you a) have met and b) you intend to get married.  Keep the information concise (30 million Skype logs is not needed).

2. Does the evidence of relationship get sent in with my form or separately?  What happens with this if I submit the application online?

When you compelte the online form, it will ask you to print out a copy and where to send all the information and how to deal with the biometrics enrollment.  You can only submit applications online in the US.

3. Is it true that my fiancee needs to send her evidence to me for it all to go together with mine, or does her evidence need to go separately?

All information should go as one package to the consulate for processing.

4. When it comes to greetings cards etc – do they need the originals of these or can we send copies? 

If originals – how do we get these back again?

If copies – do they need to be certified?

Not needed...  Again, proof that you have met and proof that you intend to get married.

Consulate should not keep anything.  They should make copies of the originals they need to keep.  If they do keep anything, let us know as this is an issue we are still working with UKBA on ensuring the consulates are consistant on.

5. Do we need to send multiple copies of our evidence?  I heard this can be helpful but I don’t really understand why or if it’s even necessary…

The consulate should make copies of anything they need to keep.  Too big of an application or too complex can in some cases confuse or frustrate the ECO.  Concise, straight forward application in a single stack of information are the clearest way to submit an application.

6. I know my fiancee needs to submit a copy of her passport, but should this be a certified copy or a notarized copy?

Notarized is a US concept, ceritified copy is a UK concept.  If you don't feel comfortable sending the original passport, have her make a certified copy in the UK.

7. Can we marry in any venue in the UK, or is it only specific places that cater for this kind of situation?

There are only certain registrars offices that handle marriages under immigration control.  If you plan to get married in England or Wales, this will step you through the process: http://www.gro.gov.uk/gro/content/marriages/index.asp

8. Do either of us need to make any sort of appointment for an interview, or is this only relevant in the case of the Marriage Visa (if at all)?

If there are any questions about your application, usually the ECO will contact you.  If they need to setup a formal interview, they will do so, but it is usually only with the applicaint.  In other parts of the world, in person interviews are common, but in the US, it is usually handled with a phone call from the ECO if needed and again that is in expeceptional circumstances.

9. Does my fiancee have to fill in any forms at all?

They should write you a letter of support saying they intend to get married to you, but as in filling out forms herself, not until you actually go to get married.

10. I heard my fiancee needs to write a letter about our relationship, but what information exactly do she need to write about?

That they are employed, in what capacity and what their annual salary is.

12. No, people won't check the house size, but do her parent's own their accomidation outright or do the rent or is it a council house?  If they rent, or the council house, you will need written permission from the landlord.

She send her stuff to you, you submit it as one complete application.  If you are asking what the proper form for the letter is, just address it to "To whom it may concern:" or really anything other then something like "To the Idiot Reading this letter:"  ;D

This is how long a piece of string.  Basically you need to prove you a) have met b) intend to get married c) she is a UK Citizen residing in the UK d) you have a place to live e) you can cloth and feed yourself without using public welfare.

As long as you applied for your application prior to your current leave to remain expired you are essentially "frozen" in your fiancé visa until the marriage visa arrives.

If the solicitor claims to specialise in UK immigration but doesn't know about the fiancee visa then please don't use them!

Ok so here is how far i am ..

    Folder all colour co-ordinated between my fiancee and i

    MY: Certified copy of Passport page and Visa page
         Degree, Driving licence, and Birth Cert
         A sponsorship Letter ( Plans to marry in May, Where we met etc)
         Letter from my parents allowing us to live here, Along with Updated Morgage   Statment along with Photo of Room we will be in.
         Employment Letter from Employer..stating my position, salary and employment for the future
         Pay slip Proving Salary £700..as i dont have another till another month(only been back 2 months)
         Orig Bank statments 3months..£3000 savings
         Budget for 6 months (Putting savings together)
         Emails to and from each other 2006-2009
         Photo's 10 of with each other.
         Flight recipts.
         
HERS: Application.VAF4A).an photo.(once done online)
         Passport...
         3 month origianla bank statments £4000 savings
         Proof of employment in the usa and letter from employer
         Driving offence original from City hall
         Birth Cert
         Pay slips

   Also letters from family and friends stating we are in a relationship..most on letterhead company paper.....

Okay..so my fiance and I just applied for our visa last week and are still waiting on the outcome...however, I am providing a list of all of the documents that we included.....did we go overboard? absolutely! We know that it was a lot but we would rather provide too much documentation than not enough..Hopefully, this list will give you some ideas--take it or leave it! Also, my fiance is on benefits for his disability--so, those sections may or may not apply--we put each section in a folder and put it in a brown holder/folder with labels! It's not an actual booking as the applicant has to be present in the UK to do that.  However, we have a letter stating that our date (July 8th, 2009) is available at the registry office.  We have a copy of the letter we sent them and a copy of the letter they sent us.  Again, this is showing that we are inquiring about the date.  Also, we included hotel bookings for the honeymoon...

I didn't think that I was going to be this nervous but I am! We quadruple checked everything before we sent it off...They only got the thing on Friday (we are using a courier) and we should hear something soon--my fiance and I tend to go overboard when it comes to these things.  I feel like I have been a part-time immigration lawyer for the last 8 months! :)

I have read up soooooo much for the past 3/4 months..I to feel like it ...all we want is to be together..So your in the States now?..wondering weather to go over in April when we do it online jsut to be there with her. But i have to work to earn the pennys!..sucks..How much was the Corrier?

Yeah, I am currently in Savannah...and I HAVE to stay here until the end of my teaching contract..May is almost here! The courier was 50 dollars plus shipping of the 8 pounds of documents via FedEx! Mine went to Chicago...we are keeping our fingers crossed. :)

Craig, if you really unsure about what to inlcude and dont want to fumble through tons and tons of posts with other people's table of contents, I would suggest a document check from a professional.  Have you looked into this?
