It's important to remember, though, that not everyone's experience is the same.  She has been effective for other people on the forum, myself included, but in my case all she did was suggest that I add a budget, which many other people have confirmed is important.  Nothing was said about proof of flight reservation or letters from friends and family, this is incorrect information that she shouldn't be providing.  Not everyone who uses her service is aware of this forum, so if she is overstepping her bounds, then Garry should know so he can work to prevent it.  It won't be putting her out of business or jeopardizing your application, but it may help other people from being misled in the future.

Also, you are unlikely to be granted the Fiancée Visa until the divorce is finalised.  This is because one you have it you are considered "free to marry" in the UK.  Which you wouldn't be.  I would think that any ECO would simply refuse you.  Sorry...

Sorry, not true.  We make fiancee visas for people who are still married all the time with no problem.  The important thing is evidence, as I said, that the divorce is well under way.

The problem with these couriers as far as I see is that they have one generic e-mail for all situations, which really confuses things.

I'm sorry, maybe it is selfish of me... but I don't want to put myself in that position. The bottom of her email says, "Note to recipient:
The information in this internet e-mail and any attachments is confidential and may be privileged. It is intended solely for the addressee. If you are not the intended recipient, any disclosure, printing, copying, distribution, or action regarding the e-mail is prohibited and may be unlawful. If you are not the intended recipient, please notify the sender."
I'm sure if you e-mail her asking about applying for a fiance visa you'll receive the same email I did. I feel bad for saying this but this whole process (as many of you know) has been incredibly stressful for me. I find a lot of the process to be confusing and my poor fiance is working his butt off in Scotland to make everything he needs to do happen and we both feel so over whelmed.

I'm going to just have to assume what the website says to be true... that I shouldn't be denied so long as I can prove my divorce is well underway. I know Vicky said one thing and kitsonk said the opposite, but at this point I'm not sure what other choice I have but to just move along as planned. The divorce decree, at the very latest, could come mid may.. and we absolutely cannot wait until then to apply. I'm so stressed out and panicked about the whole thing I've made myself sick. I should probably take your advice historyenne  and calm down.

p.s. thank you everyone for your advice and words. I do appreciate them very much.

Oooops...  Another thing to add to my long list of learnings.

If you are making yourself sick over this, why not spend a little more money for a document check for peace of mind.

to be honest, we are breaking our bank just to afford our visa application and my tickets. We're both young and have no savings, but my fiance does have a good job that can support us both once I come over.
Where can I get information/fees involved in a documents check?

No "bad mouthing" ever happens.  No names are ever revealed, and in all but the most extreme cases, the courier is never identified.  It goes in to a bank of on-the-ground profiles from which central tendencies can be inferred and acted upon.

What most people in your place don't realize is that UKBA are massively eager to hear about these things and the biggest problem they have is getting accurate info about what's happening in the field.

Please send the details to Kitson as he's actually leading on this one.

Please prepare and submit the following items:

   1. Passport - Your current original signed passport, which must be valid for a minimum of 6 months with at least two blank visa pages.

   2. Passport-Style Photographs - One color passport size photograph 2”x2” on a white background with a full front view of face. (Do not staple or glue the photograph to the application).

   3. Complete Visa Application - Download the Application Form, online including the payment of the consulate visa fee. Print and sign the application and print the Confirmation receipt.

   4. Spouse’s Passport - singed with ample validity.

   5. Marriage Certificate A civil marriage certificate issued the registrar or the relevant authorities

   6. Termination of Previous Marriage –
         1. divorce papers showing the date the divorce became final (original or notarized copy);
         2. death certificate (original or notarized copy).

   7. Letter of Support – A letter from your spouse stating that she/he supports your application to settle with her/him in the UK, and that it is her/his intention that you live permanently together as each other’s spouse.

   8. Evidence of your Immigration Status in the USA (not necessary for US citizens)and permission to re-enter the USA after your trip. Please submit original documents. Examples include:
          -Permanent Resident Card
          -Valid US visa (e.g. H1B, F1)
          - Valid I-94 card

   9. Evidence of your Spouse/Fiancé(e) UK immigration status

  10. Supporting Documents:
         1. Evidence of your accommodation in the UK:
                * Lease or tenancy agreement for private rented property; or
                * Tenancy agreement with the local authority; or
                * Mortgage papers for privately owned property
                * Title Deeds

                  If you plan to stay temporarily with family or friends, they should write a letter giving their consent to this arrangement and the evidence that they have suitable accommodation for you and your dependants.
         2. Travel Document - One copy of your round trip Confirmed Flight Reservation (You may reserve flights but do not purchase the ticket before the Visa is issued)

         3. Financial Support : You need to show that you and your spouse can support yourselves and your dependants without recourse to public funds. You must include one or more of the following documents:

                * Letter from your spouse’s employer in the UK stating the position in the company, length of service, annual salary and the position is permanent;
                * Offers of employment for either/both parties including details of salary;
                * Recent bank statements for most recent 3 months and savings account showing sufficient means of support while employment is sought in the UK or for indefinite support if no employment is planned:
                * Educational or vocational certificates and C.V. to demonstrate qualification for potential employment in the area in which you plan to live;
                * References from pervious employers with approved leave (if applicable);
                * Enquiries made regarding employment in the UK.;
                * Plans for self-employment in the UK.

         4. Applicant Letter of Intent – You should write a letter giving the purpose of your trip, arrival and departure dates, arrangement for accommodation, transport and other expenses you have made, your address, phone number. Address this letter to the British Consulate and sing it.

This is the same courier I used and I could have gotten into BIG time trouble if I had not found this site.

I'm also interested in getting the source which asks for 3rd party attestations abuot the relationship.  This is full-out, flat-out wrong.   I'm surprised there's ECO's in the field this poorly informed....

You do have all the housing information don't you?  If he is staying in a rented flat/council house permission for you to stay there, or of he owns (or someone else does, such as his parents) proof of the deed. 

I just wasn't sure from the way you phrased the last point.

No, ECO's.  Couriers are just spewing back what the ECO told them to say.  Or what they think the ECO told them to say. 

On the surface it looks like a problem with couriers, and we are treating it like that for expedience.  But the root issue is the free rein given to each post to tell the couriers what to publish. 

So at the end of the day, the problem comes home to UKBA.

He'd been living with his grandparents until this month. On March 1 he rented us a flat and he put my name on the lease when he signed and paid for it.
