FLR question
« on: March 11, 2009, 04:24:49 PM »
hello,

my hubby and i are currently in the US (i am USC he is the brit).
we have decided to move back to Wales in the fall because of work, so i need to apply for the spousal visa again.

i lived in Wales with my husband 3 years ago. i received my spousal visa back in jan 06 and lived in the UK for a year and a half. since i had to go back to the US for work, i had to let my visa expire.

my question is- do i have to apply again for the same FLR? or is there another avenue being married for more than two years? we've been married 4 years now.

any advice is appreciated,
thanks

You need to apply for the 2 year spousal visa.  In order to get the 'KOL required' endorsement, which would mean that you could apply for Indefinite Leave as soon as you pass the test, you shouldhave been married for 4 years and living outside of the UK.  However, we have noticed that sometimes consulates have been issuing this endorsement (in error?) to people in your position too, so it may be worth asking!
