i'm confused, you posted this using the exact same username on another message board:

Quote
i am an american applying for a uk spouse visa. im married to a british citizen. we been married over 4 yrs now. i have been visiting him back and forth on visiting visas. now its come time that i need to apply for my uk spouse visa to be able to go there and settle with him. it took so long cus we werent sure where we wanted to live- uk or usa.

it's hard to understand exactly what answers you're looking for between the posts on this board and the ones you've written on the other board...

Just wanted to add that on the other thread that was locked, you admitted you have visited emergency rooms whilst here. That is using the NHS.  You have stated that you are putting in your letter that you haven't used the NHS which is not true.

And I would also readvise that you get advice on your letter.  You may say that you are really sorry but I don't believe you one bit.  You keep sprinkling your posts with "never hurt anyone," "that can't be my fault," and "I didn't know."  I have no idea if you are being willfully obtuse but you are coming across to me as someone that has an attidude lacking remorse and having a real sense of entitlement.  I would worry that it comes across in your letter of "apology" as well.  You might want to consider that.

And I will throw my thoughts in that I actually hope you get denied as well.  I think if you do get your visa, you have zero consequences for your willful ignorance.  This kind of thing is what is leading to these sweeping immigration changes negatively affecting us all.

I think it is important to stress that we don't know this lady or her situation.  It is really not appropriate on a board which is supposed to provide support that people voice a hope that someone is prevented from living with her family.

I have seen plenty of situations like this, and we have heard of several on this board.  I have seen situations where people were mislead by legal professionals to the extent that they become overstayers.  Let's not judge here, please.

Very well put.

[MOD NOTE]

I'm not going to say it again.  Move on, people.  If you don't have concrete advice then leave it.

Any more 'you were wrong and you should be ashamed of yourself' type posts will be deleted and more threads will be locked.

I did not lock the others so that you could have a go here.  Every single member of the forum does not need to join in on this.

Thanks Mindy & Vicky.

I like your support Vicky.

Everyone seems to be having a go at me. It's not right.

I dont need to be critizied. I have said 1000 times I know what I did wrong, and I am very honest and sorry about it. I dont need replys from people saying "I dont believe you one bit". Just leave it out. Just stay quiet. I'm glad my other posts are locked.

Thanks to those who HAVE helped me and understood me.

Everyone else seems to be taking advantage of this to have a go. It's like they are enjoying it.

I know what I have to do now thanks 2 those who have given me proper advice.

Cheers  :)

No stirring, please.  You've asked your questions, you've got as many answers as you are likely to get.

If you have new questions then please ask them, otherwise we try to keep this kind of back and forth to a minimum.

Mod notes apply to everyone.

Anymore posts in the Visa section that are not about your application will be deleted.

Just an FYI for those coming across this thread in the future:

UK Driving License... what I would like to know is is it against the law for visitors to apply for a license when in UK as Visitor??? I never knew about this and never had any problems when applying. Nothing was told to me. It was really easy, and simple. ???

Residency rules

Normal residence means the place where an individual resides because of personal and or occupational ties. To hold a driving licence issued by the Driver and Vehicle Licensing Agency (DVLA) will also mean that you will need to have a permanent address in England, Scotland or Wales.

If you're a visitor you cannot have a UK license.

I was going to include my provisional license counterpart and theory test cert as part of my application... it shows address proof... and I actually thought it would be good to have with my application (before this forum pointed out Visitors aren't allowed to get one).

Is it a bad idea to include this now?

It could be a catch 22.

On one hand it shows proof of an address that you were not (immigration wise) legally allowed to be living (not visitng) at and doing things as a visitor you're not allowed to, irrespective of the overstay (which just compounds things).

But if you don't provide it you could be accused of trying to hide the fact that you overstayed and did things you should not have whilst in country. However, it does show that you are being transparent.

I still recommend professional preparation of your application since there is so much that needs to be addressed properly.

Hi,

Thanks for the reply. I know alot of people are telling me get professional advice, but I just simply can't afford any fees after the Visa Application Fee. It's very hard for me. It's as simple as that.

I know Vicky had told me to disclose everything in my Apology Letter which I am working on right now. I think it is safer to send it with my Application, and disclose everything like she said so... It will be mentioned in my Letter anyways. Thanks, I came to this solution with the help of your reply.

Can you throw it on a credit card or borrow the cash, or something?  Your situation sounds too complicated to just go it on your own, especially if there's any mistakes that could be avoided with professional advice.  Considering you'll be out the application fee regardless of whether it's approved or not.

I am borrowing the money, thats why I am struggling paying for anything else!  :D

My situation is not complicated, this board full of 5 pages has just made it a mess! I have already seeked advice from a Professional Lawyer in United Kingdom recently who happens to be a good friend of my Uncle :) He knows my situation and says they cannot refuse me just for one reason - Overstaying.

I trust his advice as he is an Immigration Lawyer.

If the board made it a mess, why are you seeking advice here?   This isn't snarky, I just don't understand what you're getting out of the threads here if you have already have professional advice.

Anyway, good luck.

Hi,

I didn't seek advice until a few days ago. I know people here are not professionals, but I wish ones that do not know, would not say anything at all. Half the board gave incorrect advice. Then again, I understand its not professional advice.
