Thanks for replying. Regarding the overstay, I was only mentioning what she mentioned in the email reply. I was pointing out the fact that she does not know information, and is incorrectly advising me.

As for finances, I thought 3rd party support was not allowed? Doesn't that come under as a co-sponsor? I am alittle confused about this. If you can clarify this for me please.

I am disclosing everything in my Overstay Letter, like getting my license, bank account, GP...ect. Is it not better to disclose everything? That is why I was including NHS Card, and the dinner menu was just part of wedding proof. I thought providing the more, the better?

Also...

My husband can show reciepts of payed bills/rent for every month.

He pays his bills with a card the companys provided since he doesnt have a bank account. He takes the card to any bank and pays the bill off and the a week later they send a reciept showing hes payed so and so amount on so and so date.

Rent is payed in cash into landlords bank account, and reciept is given straight after.

This should be ok am I right?

What exactly is the Financial Test?

I heard that's what they do in order to check if you meet requirements in regards to being able to support yourselves. With my husbands income, we have a good 5-600 left over at the end of each month, after rent, bills and tax are payed. This is 150 left over each week. This is over the requirement of 100.95. Does this mean we pass the test?

Also, if we meet the income requirement, then what other problems could there be in regards to Finances? We have plenty of proof to show that our bills/rent are payed. Without a bank account, this is still possible.

My husband always recieves reciepts and payed statements after paying rent/bills.

Any answers please?

Hi, I know I have written about this before, but I am completely CLUELESS on how to write my Overstay Letter.

I know the ECO just want the facts, and the facts are:

*Visited in Sept 2004, Overstayed from that time until October 17, 2008. During this time, I was advised completely wrong that I could get settlement while in the UK.

*Went home on Oct 17 due to father passing away. Lost passport in this mess, applied for new one and returned to UK on Nov 17 2008 with a 6 Month Stamp. Nothing asked about previous overstay.

*Returned to USA on May 1 2009 for younger sisters graduation. Had a return ticket for May 3rd, but extended it until May 11. In the middle of this time, I researched Spouse Visa, and decided to apply for this Visa but needed to return to UK to gather some personal belongings and documents. Refused entry upon arrival UK on May 11 because of Previous Overstay.

Now I am having such a hard time turning all of this into a letter! I would love to get a professional to do this for me, but I can't afford the fees right now - so if anyone can help me, give me ideas, or even show me a sample overstay explanation letter, I would REALLY be grateful - need to send my application documents off in a couple weeks and I need this letter done asap!

I am not an expert on overstay letters, however I do write many professional letters.   In general professional letters it is acceptable to write out a time line in bulleted form.  This will save space in the letter and let you just tell the details that are important without any of the connecting information.  So it could look like this.

Dear xxx,

I am writing requesting xxxx.

My past entrances into the UK include:

First experience
Second experience
Third experience, etc.

Other relevant information requested in paragraph form ...

Sincerely,

xxx

You also need to include food. Rent, water, electric, food, council tax. They count food as a needed expense. So after those bills you need to have £100.95 left per week. They also will not believe you can feed two people off of £20 or £30 per week.

Sorry, but you are incorrect here.  The budget should be done before food and entertainment.

The budget is just Rent/Mortgage, Utility Bills, and Tax am I right? So with that, having 150/week left over is sufficient? Is that was the Financial Test is?

Or is it more then that?

Hi,

Is a Co-sponsor allowed in a UK Spouse Visa Application? Since my husband does not have a bank account, I was thinking of adding my Mom's statements and a letter from her stating he is always there for us incase we ever need any financial help from her.

1) Is this allowed?

2) If so, what does she need to provide? (Just 3 months statements and letter?) She is not working but earns pension since my Father passed away.

3) Will this help make my application alittle stronger since my husband does not have statements to provide?

Thanks for any help. This is a new question so I hope I can get some advice.
