I think Garry has read enough of my posts and knows by now I am applying for a Spousal Visa. And if it's not allowed, then ill stick to that. He probably meant something else.

Dear Sir/Madam,

My application includes an Immigration Refusal which happened on May 11, 2009. This was due to a previous overstay.
 
I visited the United Kingdom in September 2004 on a 6 Month Visitor Visa. The purpose of my trip was marriage. During this time, I sought advice from an Immigration Lawyer about settling in the United Kingdom. I was advised that I could obtain Settlement while in the United Kingdom. My lawyer at the time dealt with my case for a long period. Eventually, through my family's research, I became aware that it was not possible to obtain Settlement while in the United Kingdom. I was advised wrong through this Lawyer and I made plans to return to the United States in order to apply with the proper procedures.
 
I returned to the United States on October 17, 2008 due to my father being ill. He passed away 7 days after my arrival. I had no intentions of applying for my Visa during this time. In the middle of the stress and confusion, I lost my passport. I applied for a new passport and returned to the United Kingdom on November 17, 2009. I was stamped with a 6 Month Visitor Visa. During this time, I pulled myself together after my father's death and made plans to return to the United States on May 1, 2009.
 
I returned to the United States on May 1, 2009. I started doing research on how to apply for a UK Spouse Visa and started collecting the proper documents. I did not know until I did further research that the Visa process could take up to 3 months. I booked a ticket for May 11, 2009 to return to the United Kingdom as I needed to pick up a few personal belongings.
 
Upon my arrival at Heathrow Airport, London, I was denied entry because the Immigration Officer was not satisfied that I was only trying to enter as a Visitor to pick up some belongings. He requested to see my marriage certificate, which I did not have with me. He then refused me entry because he did not believe my intentions were genuine and did not believe I was married.

I would like to include that during my Overstay period in the United Kingdom, I did not seek employment or work at all, I did not use the NHS or otherwise rely on public funds for support, and I lived with my husband the entire stay in a non-council residence. With that said, I would like to include that I did get my Provisional Driving License during this time.

During my recent 6 Month Visitor Visa, I opened a Barclays Bank Account, and registered with a GP. I also passed my Life in the UK Test.

I would like to apologize for this Overstay and hope this letter serves to clarify the reasons why it happened.

Well, ignoring a user doesn't block the user's threads from floating up the Show Unread list. It doesn't accomplish much, really, but white out the text of that user's individual replies but leave them in position in the threads. So it's not like a "magically make this poster vanish" option.

Still, as annoying things go, it doesn't rise nearly to the level of that dry tickle in the back of my throat I've been trying to ignore all evening...

Hi Ilak :) I think your letter has gotten much better, but is probably still quite lengthy.
I'm concerned about this sentence :

"I visited the United Kingdom in September 2004 on a 6 Month Visitor Visa. The purpose of my trip was marriage."

- Someone may correct me, but I don't think you're supposed to enter on a visitor's visa with the intent of marriage, did you declare this to the IO at the time? Maybe an apology for this is warranted - someone with more knowledge may correct me.

If this has been answered else where, I apologize, but can we clarify the point on whether you used the NHS or not?

In some of your threads you state you had an NHS card, and in others that you didn't use the NHS. Are you absolutely certain that you never used the NHS. The NHS can included subsidized dental, eye tests, prescriptions, GP visits, ER visits, inoculations etc. 

I just think it would be best to tell the truth whatever it may be, in case you get "caught" out, if that makes sense :)

There are also several grammatical errors, do you know anyone in your real life who would be able to proof read it for you? I think it helps give a good impression.

Hi Leah I meant I have 2 threads with the same letter question. I didn't mean to make 2 threads. I thought the first neevr got posted so I posted another one, then afterwords i found the OLD one, and realized there were 2...

The replys that I recieved for my other thread... with the letter, I am getting advice there and here now, is there anyway you can bring those answers to this one so its just ONE thread.... I'm sorry I know this might be confusing...

Just want one thread for both. Because if I reply to the other one as well as this 2 will be going on, and that's what you asked me not to do...

Not to butt into the middle of a thread (maybe I've had one too many Shandys tonight, just get that out of the way right off) but I've read that food and entertainment are not included as deductions towards the required minimum amount.  Should we just exclude those things from the budget we prepare for our visa application, or should we assume the person reviewing our application will take those out of the equation?  Basically if my detailed budget shows I have 75 left over at the end of the month, but once you take out groceries, entertainment, and any other nonessentials I actually have 200 left over, should I point this out in my application or assume the ECO knows the difference?  Or should I just do a very simple budget, excluding those nonessentials to begin with?  We're cutting it close on our application when we include all the nonessentials but doing fine when you take them out of the equation (which is why I ask for so many seemingly insignificant details).

Make a simple budget EXCLUDING food, entertainment and shandys :)  
Your budget for this should include mortgage/rent, loan repayments, car payments, petrol/transportation, council tax, utilities and other NECESSARY expenses that you may have.  Everyone's will be different, but these are usually things that are included.  Make sure that the bank statements you include match up with the expenses that you claim.

However, if you are going to be relying only on the income you mention above for this application, 200GBP left over each month will not cut it.  They require 100.95 each week to make up for all the expenses that will not be included on the budget.  

Does that make sense?

I'm not 100% sure, but I think back in 2004 you were allowed to get married on a visitor visa without a COA, so she would have been okay entering to marry.
