Hi,

I'm sorry I have quite a few threads regarding my Spouse Visa. I keep remembering things I need to ask, and think its better off having a new thread rather then confusing the other ones  :-\\\\ Sorry to anyone who finds this rather annoying/confusing.

I would like to know if anyone could kindly tell me where I can get a certified copy made of my husbands passport as he's the sponsor? Lawyer? They can charge alot! Anywhere else I can go to get this done? Or should I just send in the actual passport as he won't need it anyways.

Thanks for your help  :)

Oh ok. I'm sorry Mirrajay. My mistake.

Does anyone know what my overstay letter should contain... detailed or brief?

Just need some good opinions. Such a headache getting things done right.

Thanks

I think garry gave you some good guidelines to go by.

If he is in the US, you can go to any Notary Public to get it notarized.  Most banks will have a notary and AAA has a notary.  In the UK, I think the only people who can make a certified copy are solicitors.

I'll be honest with you - It probably would have been easier for you to have one thread with questions, as all these threads are getting confusing with all the overlapping.  You also should read through the visa board, as a lot of your questions might be answered without needing a new thread :).

If you're doing it in the UK, get everything you think you'd need notarised/certified together.  Find a notary/solicitor and get it all done for the flat fee (I can't remember what we paid, but it was less than £80 a few years ago).  We had our lease copied as well as my husband's passport. Yes, it's more expensive than in the States, but I don't think it's as commonly used here.

First, a 4 year illegal presence in the UK is not just a 'mistake' that can be easily explained or dealt with. You need a professional to assist you. I suggest contacting an OISC approved adviser that will have the knowledge and expertise to assist you properly. The vast majority of the people here are just lay persons who have been through the process and have learned a bit along the way.

We do not have the proper knowledge or experience for the situation that you have put yourself in. You need a professional.

As Garry said previously a lengthy apology for a 4 year 'mistake' would most likely just tick off the ECO that gets your case. Seriously, you need professional advice and assistance with your situation.

ETA: You need to read your refusal letter very carefully as well and check that they did not mention that you had tried to use deception to enter the country. If they did then you very well could have more problems then you realize. You also say you returned in October 2008 to the US ironically this was the extention date that overstayers had to be out of the country in order not to have a 10 year ban. Then you conveniently 'lose' your passport and get a replacement in less than a month and return to the UK in November 2008. This is precisely why American Women have a bad reputation with the immigration authority in the UK.

As I've said in another of your multiple threads...your case is unique, complicated and cannot be considered 'straight-forward' and most of us here cannot provide a yes or no answer to your question. You need the assistance of a professional of which 99.99% of us here are not.

Hi ilak19--I was just reading your previous thread about your overstay. I'm not clear between these two threads if you have been using the NHS or not? I know that you have been advised to consult a lawyer with regards to preparing your application, as they will definitely need to do an investigation in to your overstay, and will be looking for things such as how you supported yourself, and whether you used the NHS/other services etc.

i used this service offered by the Post Office, I wasn't questioned about it when using it for my Spouse Visa.

ilak - no offence but in one of your other threads you mentioned that you had engaged a new lawyer. If this is the case, I would highly recommend you address these kinds of questions to him/her. It is only going to complicate matters further if you are seeking advice from varying sources, particularly when yo uare doing so online and the people responding can't see your documents.

Best of luck with your application.

Wow, you were able to get a driver's license with just a six month visa?  No wonder so many illegal immigrants come to the UK.

A post office 'certification' is not universally accepted.  Be careful.

I think it is important to highlight that there are many, many people who have been in this position who have been granted spousal visa following lengthy overstays...at least two from this site.  Some have used professional help, some have not.  Don't think that your history means an automatic refusal.  You are applying from the US, which means that the rules will apply.

One thing you can't have is third party support, so I'd take out the letters from your mom and sister.
