Absence from UK on FLR(M) Visa
« on: August 24, 2009, 11:13:46 AM »
Hi,
I am looking for the rules about how long I can leave the UK with my British husband and child.  I have a FLR(M) visa and I want to apply for the ILR after the 2 year period is up.  We are planning to travel in the coming year for an extended time in Asia, and need know how long we can leave for and still be able to get the ILR.
I heard there is a 90 day absence period, but I am not sure if this is 90 days in one year, one visit, or in the total 2 year period.
Thanks

There is no set days in or out of the country for ILR SET(M) applications under the Family Path, only for Citizenship under the 3 year residency period. However you would probably have to prove that you have maintained the UK as your principal country of residence.

You will still have to show that your relationship is ongoing, which could be difficult if you are travelling, so keep that in mind.  Letters addressed to both of you, tickets, reservations etc in both your names will be useful.

We do not inherit the Earth from our ancestors; we borrow it from our children.
