Filing Taxes before 330 days residency?

I've just done (but not filed) my taxes and am due a hefty refund.   I am confused about the Foreign Earned Income Exclusion... In order to claim this and even further increase my refund, do I HAVE to wait until I've been here for 330 days or is there a way to file and receive the refund (without the exclusion) and then amend and claim the additional refund?

I believe to qualify, you have to have spent 330/365 days of the US tax year beginning January 1 to December 31.  I dont think you can claim it if you say came to the UK on July 1st

October 8, 2010:  UK Entry Clearance Recieved! (3 Year Anniversary!)
January 6, 2011:  Civil Partnership Ceremony!
March 7, 2011:  FLR(M) Granted!
January 24, 2013:  Passed Life In UK Test
February 28, 2013: ILR Granted!

I had a tax person do my taxes...
I got here Jan 27th 2010 and he rounded up the almost year to Jan 2011 - so with vacation I made up the 330

Mirra - I can show you my taxes if ya need me too.  I am sure you have been here long enough to get it.  As for a hefty refund sweet for you, I got nada even with rental property since I only got back the small amount I paid to the US since I am obligated to pay the UK.

This thread is over a year old - mirrajay asked the question in March 2010, so I'm guessing she probably got it sorted out last year...
