should i SUE?! help please!!!

i was studying from 2007 to 2009 at a school in canterbury, kent.
i was a full time student from the US studying full time a this uni, having two years of uni from the states under my belt

my final project of my second year i failed. i resubmitted (with no response to my emails and no tutor assistance) and received the EXACT SAME GRADE. i redid it AGAIN. finally met with a tutor (NOT the one who taught my class) and was only given a 3 point rise. not enough to pass.

after appealing, i was told i would have to pay full tuition (£10,000/year) to redo the one class and only be able to receive a 40 (the capped highest mark available on a redo).


it has been A YEAR since i last technically attended this uni and i'm now back on a visitors visa with my english boyfriend. I STILL DO NOT HAVE MY TRANSCRIPT. i cannot apply to other schools because of this.

should i sue this school? my tutors were wives of other tutors because they had no staff. my emails went unanswered. and £30,000 was wasted keeping me over here studying only to be given the SAME GRADE.


please help. any legal advice is welcome. cheers!!!

What basis would you have for suing? You agreed to pay the extra tuition to re-do the project, and got it re-graded. Unless you feel that the grading was done unfairly all 3 times and you should've gotten a pass (without requiring a re-grade/extra £10,000), but even then, you paid the tuition for the grade. It's not like you get to not pay back student loans if you fail a semester.

I also don't see how you could get £30,000 out of the school, either, if tuition is £10,000. They're certainly not going to reimburse you for your living expenses while waiting on a re-grade that you signed up for.

So...color me confused.

Have you requested your transcripts?  My uni sent a letter with a seal that certified my coursework upon my request.  I didn't get a proper US style transcript.  If you were not awarded your degree because of the failing course, they may not give it to you.  That's conjecture on my part as I can't see a reason why they wouldn't provide them.

As far as your final project is concerned, suing the school isn't going to get you anywhere.  You were given an opportunity to resubmit your (I'm assuming) revised project and then appealed.  Simply because you didn't get your way doesn't mean you have legal recourse for action. 

Did you speak to the head of your department regarding your lack of contact with tutors?  Did you speak to your course administrator?  Email was not your only recourse for having contact with people.  Unless you exhausted all avenues available to you, you can't really hold the school responsible.  The guidelines regarding tutor assistance may be different after a failing mark anyway.  Does your student handbook offer any guidance?
