Topic: Do you HAVE to have sponsor for DCF?  (Read 1313 times)

Do you HAVE to have sponsor for DCF?

Assets Needed -> Secondary sponsor (located in US) with income of 125% of
national poverty line for their household size or liquid assets of three
times the national poverty line**

Filing from the US -> processing time 9-13 months
Assets Needed -> Sponsor located in US (you or other) with income as above

I am just at the beginning stages of researching this issue and had a question on this bit.  Am I reading it correctly that if I am living in the UK and apply for my BF (husband by then), we MUST have a secondary sponsor?  So if I secure my transfer to the US, I cannot be the only sponsor unless I go ahead and move to the US without him (for undetermined number of months)?

I don't think it is impossible for the USC to be the sole sponsor, but I am not sure whether just an offer letter would be enough or if US immigration would want to see payslips too.  There is something in the I-864 guidelines about the intending immigrant's income being able to be used if it will be coming from the same source.  If the logic is the same for the sponser,  and if you are being transferred internally by your company....you may have a very good shot.  People on Dive Into America forum may have more experience.

I was/am my DH's sole sponsor when we DCF'd 2 yrs ago. Since we both were quitting our UK jobs to move, and had no new jobs lined up yet we qualified based upon the asset formula. If we had not had enough assets, we would have needed a US based sponsor.

They look at past tax returns for previous income among other things, but I cannot say for sure if a letter of offer for employment in the US would be good enough to qualify based upon income.

If you do not have jobs already line up in the States, you will 5 times the poverty level in liquid assets - that is cash on hand - not investments or a house to sell.  Now if you have an offer on your house and the sale is proceeding with a set completion date, they will consider the proceeds of sale as your liquid assets.

We had to get my dad to be a secondary sponsor using his income and assets to get the five times the poverty level.

Yeah I don't have enough assets to count.  

We wouldn't move before either one or both of us had a job.  We are both in really competitive fields so I am not concerned about livelihood. It is just one of those things were the timing seems to not be ideal.  I wanted to go ahead and kick off the DCF process and then do the job transfer because the job thing would need to happen really quickly once I started that process.

Guess we will look for him to get a work permit instead.   ::)

ETA: Thanks for the responses overall.  This process is a bit daunting and I have not yet wanted to get into the thick of it yet because it is all so stressful.  I need to get past my own UK immigration issues first!

I was also the sole sponsor 2 years ago for my husbands DCF, but we had enough in savings that I didn't need a secondary sponsor.
