Ok sorry ive never read anywhere that says to take it before you apply for the spouse visa i was unaware

The test can be taken by anyone at any time, there is no specific residence requirement - though I hear they have been asking for proof of UK address recently.

However the 'KOL Req' endorsement is only available to those who have been married & living together outside the UK as a married couple for 4+ years. It must be requested specifically in the sponsor letter and should have been mentioned in a cover letter from the applicant that they are requesting the 'KOL Req' endorsement. They don't just give it out even if you do qualify for it, you have to ask for it. It allows the applicant, upon entering the UK on the spouse visa to take the test and if they pass, apply for ILR immediately.

Or, they can take the test in the UK as a visitor, then apply for the spouse visa, supply the test certificate & all the other required documents for the visa and specifically request ILE (Indeifinte Leave to Enter) thereby never having to apply for any other visa in the future.

Since it doesn't apply to you and your situation then it's understandable that you wouldn't know about it. Which is why it is good to limit your advice to things that you have specific knowledge of or can cite your source and information properly.

I didnt give advice on it i said to call and ask the home office if it was still possible to get it since they requested it but was given the normal spouse visa thats all i said i also said it doesnt hurt to call and ask them directly since they are the home office but only have heard of people fixing the visa before entering the uk not sure if your read what i said earlier or not but it was at no point giving professional advice

Yeah, the proof of UK address requirement was added last summer, which essentially now rules out the possibility of being able to take the test as a visitor for most people (since you need UK utility bills/bank statements etc. to prove the address). Although if the applicant already has an address/bank account etc. in the UK from living there in the past and are still receiving mail at that address (perhaps at their inlaws etc.), I guess they may be able to use it to take the test as a visitor.

Got an email with a request for my court records.  I've got papers from one court. It's only got the codes of the violations and the prices that I paid for the fines. Is that fine? I'm driving to a court 12 hours away so that I can fax them in ASAP.

Got an email saying that my package was opened and sorted today 12/8.
Got an email with a request for my court records.  I've got papers from one court. It's only got the codes of the violations and the prices that I paid for the fines. Is that fine? I'm driving to a court 12 hours away so that I can fax them in ASAP.

Got my email today! Visa issued!

So happy can't wait to see my baby and officially start our live together!

Yeah, unfortunately you can't complain unless they go over the processing target time of 12 weeks... because until then they are still within the stated possible processing time on the UKBA website and complaining now won't really help anything.

Yup totally agree i just wish i didnt have to have been waiting this long but hey maybe theres hope for me sometime soon as Basics sent his off just a few days after me so him having his gave me some hope  ;D

I just feel like my application was as complicated as it gets and I doubt yours can compare.

I had 3 refusals, a removal, a criminal record, and 3rd party financial support.

Mine pretty much should, have taken the longest time possible.

You haven't even got an email stating that they got it.  Ive received 4 emails since they got it.

Using you mp won't hurt anything and they usually love helping when they can.

My Husbands MP wants copies of all paperwork sent over to the British Consulate as he doesn't personally know any of us... as well as when the Lawyer filled the application in she wrote the legal teams corporate email address as applicants email address so that may contribute into why i haven't heard anything so either way it will come in the mail or she will call in 40 days if not

Have you tried contacting Worldbridge at all? (It costs $3 per minute to call, but you can email them in regards to a specific application for free). Technically, they can't do much to help but they might be able to find out if the consulate have actually started processing your application yet.

I may be wrong, but I thought MPs could usually only help with applications actually made in the UK (such as FLR(M), ILR or switching between other visa types), not with applications made abroad.

Duke, with mine they emailed when they received it to say it was in process, but that was with priority service. I am not sure if they wait to email once the actually start the assessment or how that works. Best of luck to you.  :)

In my case I had my mp help while I was in the uk. I asked them to look into my current application and they said my wife had to ask them because I wasn't currently in the uk so I was not a constituent.

As long as your other half is in the uk you can have them try and help you out. My mp found out that my solicitor has my refusal and they didn't tell us for 3 months. We could have got in even more trouble if our mo hadn't told us!
