Well considering you don't have to see him since I don't see why you would.  Maybe they mean intervening devotion, in which case you have to send them proof you've remained in contact, did you do that?

sent them phone bills, along with skype calls, chat logs, emails, phone calls and Facebook contact

Aug 8th, 2012: Oral Hearing
Aug 16th: Letter from Judge Visa Approved
Nov 15th: Email Requesting Passport from UKBA NY
Nov 16th: Sent off Passport Via UPS
Nov 19th: UPS confirmation delievered
Nov 26th: Visa Issued :D

Sounds like a weird refusal reason, was it the only reason they gave?

yes. Same thing the lawyer said so we are doing the appeal

Either way for everyone asking yes we are Appealing my Laywer and Husband will are planning on attending the Oral Hearing

Good luck, it sounds like a poor refusal reason from what you've said.

Out of interest, I noticed you hired a lawyer from the start, did you have any particular reasons, ie difficult immigration history etc?

was refused entry, as well as have children who are not going with me

Hello everyone, been in the UK on a spouse visa for almost 2 years. Split from my wife of 7 years marriage. We have 3 wonderful children together. I sent in my application for Access to Child, on January 23, 2012. Internet says processing better chances of getting notice in 5 days. Last time, for my spouse visa, I waited 5 months, all along my 2 children at the time are missing me. That was through LA. So I hope New York really is Faster.

Had first child:Aug 2005
Had second child: Oct 2007
Married: Dec 2007
Entered UK:Sept 2009
Left UK: Aug 2011
Applied for Acces to Child:Jan 23 2012
Aprroved or Denied:awaiting approval

they think our marriage is a scam bcz we haven't seen eachother since our wedding

I'm so sorry to hear this phillymirah.

I have to say, my heart leapt into my throat when I read the reason they gave. My husband and I won't be applying for 10 months after our wedding and due to the sheer cost of moving we won't be able to see each other between the wedding (this past Oct.) and when we apply. So I'm a little unnerved right now, lol

Appeal was lodged Yesterday. Just want to say Thank You to everyone who has been emotionally supportive of me through the Visa Application as well as after I got the Refusal. Even though I didn't post since because I was down as well as working with my husband to give the Barrister more then enough evidence of our relationship I am feeling re-assured and better now although I have come to the conclusion that if it's meant to be it will be and if not then fine we will just try again. Don't worry I won't stress this time like I did waiting for the Visa decision lol I will let my hubby stress this one out  :P
