A San Francisco federal judge today struck down California's ban on same-sex marriage, concluding that it tramples on the equal rights of gay and lesbian couples and setting the stage for an appeal that appears destined for the U.S. Supreme Court.
In a 136-page ruling, Chief U.S. District Judge Vaughn Walker sided with two same-sex couples that challenged voter-approved Proposition 8, which embedded a ban on gay marriage in the California constitution and wiped out a prior California Supreme Court ruling that briefly legalized same-sex nuptials across the state. Walker ordered that Proposition 8 should be immediately voided, and same-sex couples be given the chance marry across California.

Some people are surprised that Judge Walker didn't excuse himself from the case since he is gay.

People also saying that it will end up in the Supreme Court who will refuse to hear it and they will send it back as matter for the states to decide.

I posted about it on Facebook and of course, my uber religious family couldn't help but hate on it. It's funny how they can post annoyingly conservative crap all day and I just ignore it, but they always have to argue with my statuses and act all offended.  ::) God, they really annoy me. They could care less about me, I'm such the black sheep. /rant.  ;)

To add to what you have heard....


Why would he need to excuse himself, if a heterosexual married judge was up there, wouldn't that be favoring the defense or clouding the judge's mind, just as the argument goes against him presiding over the case?  Being gay does not = can't think with a judicial mind. 

we never know what the SC will do and it is hard to speculate since it will take at least a year for it to go through the appeals court, if not longer.  If the appeals court upholds the Walker decision and the SC denies hearing the case, that doesn't mean  it goes back to all the states.  The appeals court decision (or the 9th circuit) will stand for that entire region of the US.  Outside of the West region (9th circuit) it will be up to the states until it is brought back into the courts again.  If let's say another region (circuit) takes it through the Fed. courts and they have an opposing decision then the 9th circuit, it increases the chances (if not guarantees) of the SC hearing the case.  (this scenario is what happened with school segregation)

This is great, not only because of gay rights, but more importantly, because it means that a majority can't use their voting rights to bully away the rights of minorities.
