Some people are surprised that Judge Walker didn't excuse himself from the case since he is gay.
People also saying that it will end up in the Supreme Court who will refuse to hear it and they will send it back as matter for the states to decide.

Why would he need to excuse himself, if a heterosexual married judge was up there, wouldn't that be favoring the defense or clouding the judge's mind, just as the argument goes against him presiding over the case? Being gay does not = can't think with a judicial mind.
we never know what the SC will do and it is hard to speculate since it will take at least a year for it to go through the appeals court, if not longer. If the appeals court upholds the Walker decision and the SC denies hearing the case, that doesn't mean it goes back to all the states. The appeals court decision (or the 9th circuit) will stand for that entire region of the US. Outside of the West region (9th circuit) it will be up to the states until it is brought back into the courts again. If let's say another region (circuit) takes it through the Fed. courts and they have an opposing decision then the 9th circuit, it increases the chances (if not guarantees) of the SC hearing the case. (this scenario is what happened with school segregation)
