Travel to US after Interview and Approval
« on: December 22, 2010, 09:14:55 AM »
Hello,
My name is Ben, Im a US citizen from Alaska currently in the UK with my British wife and staying on my Spousal Visa. We are in the process of getting her US Greencard so that we can live back in Alaska where I am from. I'm leaving the UK before getting my ILR and Citizenship, a little over a year is long enough here.
The question I have is this, after my wife has her interview and is approved to travel to the US and activate her visa, is she required to be with me when she enters this time? I need to be back in Alaska at a specific date in Feb and if the interview has not taken place by then, I will need to go on ahead if that is allowed. As of now she has just completed her Medical at Knightsbridge and awaiting her interview.
Thanks,
Ben

I believe that she can travel alone on her visa, as some are issued the visa while their spouse is in the US without ever have been in the UK to begin with. Plus since the visa process is quite long it's understandable that the US Spouse may not be able to travel with the visa holder.

You may want to check the Repatriation section of UKY (which deals specifically with going back to the US & the vissa process for going to the US) as there may be a first hand experience documented there in the older posts.

No, she doesn't have to be with you when she enters the U.S. :)

Ok, thanks for the input! I'll check out the repatriation page for any further questions regarding our situation. ~Ben
