Actual timings?
« on: August 26, 2004, 02:31:06 PM »
Hi all,

Reading some signatures, the 12-week wait time seems to be a little off...  Marlespro for example filed on the 1st of June, but then got a confirmation on the 26th of June saying to wait 12 weeks *from then*?!  Doesnt that make it more of a 16 week lead time, or am I missing something?

Also, just noticed something else...  Marlespro filed the DS-230 and DS-2001 at the same time?!?  Was I supposed to do that??  I posted the I-130 today, but no DS-230 or DS-2001?!

Thanks!

S.

If you file the DS-23o (part 1) and DS-2001 at the same time as the I-130 - - (in different enveloped, to different people) then the whole process goes faster.

They sent me a note saying to wait 12 weeks, but it didn't take that long.

I put all of my paperwork in the mail on June 1.
Our interview is September 1.

Which is exactly 3 months. :D

Oh - and the 12 weeks? THey say "wait 12 weeks from when we got it" - NOT "wait 12 weeks from the day you receive this letter". Hope that helps. :)

Well I am a bit concerned since I started the process back in mid June. Our NOA was received on 4th August. I wrote to the embassy on 16th August and they stated our interview would be in "mid September" but couldnt give me a date. Marlespo....I took your advice and emailed them 1st thing this morning and no response as of yet. (2nd time that has happened when I have emailed them). Anyway, I am really nevous now because when I popped on to look for the visa fee today...What did I find to my complete surprise, this paragraph..

Those registered for immigration in the family or employment based preference categories are subject to the annual numerical limitation on immigrants admitted into the United States. In such cases, the appointment for the formal visa interview and medical examination will be scheduled within two months of a visa number becoming available for the applicant’s use.

I had never seen that information before so now I am worried that I am not hearing back from them regarding our interview date because we may have to wait due to a numerial limitation??? Of course I may be jumping the gun in my panic but I am very, very concerned that they would possibly limit SPOUSES of american citizens from going to the US.   :o I am going to email them again tomorrow if I have not heard back.

I am not sure how many others on this site are still in line for an Embassy interview so please keep us informed on the site as to your progress.....of course I will do the same...

Hi Jules,

Dont worry - spouses are NOT subject to the annual numerical limit.  They only mean non-immediate family members.  Spouses and children of US Citizens are not counted.  The only people that fall into the family numerically limited category are:

Unmarried son/daughter (aged 21 or over) of a U.S. citizen; married son/daughter of a U.S citizen; brother/sister of a U.S. citizen; spouse and unmarried son or daughter of a Lawful Permanent Resident (LPR).

So as long as your partner is a US Citizen and NOT just a Lawful Permanent Resident, then you should have no problems :)

Thanks!

S.
