New restrictions on jobs available to immigrants
« on: March 14, 2011, 06:24:44 PM »
Immigrants from outside the EEUC cannot work in takeaways or be hairdressers under new restrictions by the UK government.

UK takeaway jobs ban for immigrants from outside EEA

The government says it wants to reduce the need for businesses to take on migrant workers

Migrants from outside the European Economic Area will no longer be allowed to work in the UK as chefs in takeaway restaurants, the government has said.

The ruling comes after the Migration Advisory Committee (Mac) was asked to review the country's skill shortages.

A similar ban will apply to workers such as hairdressers, beauty salon managers and estate agents from April.

The number of skilled migrants not from the European Economic Area is being capped annually at 21,700.

Sheep shearers
The Home Office has already announced that only graduate-level non-European Economic Area (EEA) workers will be allowed to apply to come to the UK.

Now it has reduced the list of jobs where there is a skills shortage in the UK to eight occupations, including senior care workers, sheep shearers and pipe welders, following advice from the the UK Border Agency's Mac.

Chefs will need to have graduate-level qualifications, with a minimum of five years' experience in an equivalent role, and need to earn at least of £28,260 per year after their accommodation and food.

Those from outside the EEA wanting to work in fast food outlets and takeaways will not be allowed in to the UK at all.

'Workforce skills'
Immigration Minister Damian Green: "These changes will allow firms to bring in people with necessary skills without migrants becoming the first resort to fill a wide range of available jobs.

"This government is also determined to get people back to work and provide business with the skills they need from the British workforce - reducing the need for migrants at the same time as we reduce their number."

The government wants to cut net migration from about 200,000 a year to tens of thousands by 2015.

The EEA comprises countries in the European Union and European Free Trade Association.

This in no way applies to the family path visas right?  Not that I'm a hair dresser, I just don't want them to take financial services off the list!

I don't even know what to say about this.

LOL I love that it's on the job shortage list. All prospective hairdressers will suddenly have sheep as clients when applying for their visas.

The MAC report only affects Tier 2 General  & Tier 2 ICT's.

It will not affect Tier 1 holders, PSW holders, Students working on thier 20 hours a week & it will not apply to those on family based visas either.

Ok, so a disclaimer before I post: I have a Bachelor's Degree and a long work experience history.
Just because I feel a bit silly about feeling silly for posting this.
Also, I am American and have full ILR.
Ok, that having been said:

I applied the other day for a part time position at McDonald's (just to help pay the bills since Lloyds TSB has decided not to pay me the rest of my maternity pay, but that's another story for another time,) and the manager said I have the job, but he had to check in about this topic specifically, because he was unsure whether or not they could take me on as I am a 'non-EU immigrant'.
I understand from the above posts that this shouldn't apply to me, but could anyone suggest some proof that I could take with me in order to prove that I can still work at MickeyD's.  (How ridiculous do I feel right now?)
Anyone know where to find the specifics about which types of visas are affected?
Thanks so much for your help!

This is just for Tier 2 visas. Your ILR gives you full working rights. You could print off the page from the UKBA website or just show them your visa.
Have you considered getting your citizenship? Going by your signature timeline, you're eligible and could then get a British passport, no hassles from any potential employers.
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012

Uhh, you don't lose your US citizenship when you become a UK citizen. Really, it's pretty difficult to lose your US citizenship.
Summer 97 - first visited friends in London

Feb 02 - moved to London on BUNAC
Sep 02 - WP granted (IT skills shortage list)
Sep 04 - WP renewed
Sep 06 - WP renewed again (screwed by 4-5 year ILR change)

March 09 - Citizenship!
July 09 - bone marrow transplant :(
18 Sep 10 - wedding!
Mar 12 - half marathon in Paris! 1:47:12!
Oct 12 - Amsterdam FULL marathon! 3:48:23!
