Hello..sorry if I'm posting in the wrong bit. I'm British myself, but my partner is American and is hoping to move here next year. He's recommended this site, as I'm finding the whole visa thing complicated and although he's very patient..I may be pushing my luck!  :P I hope I'm welcome to lurk and maybe pick up from other peoples experiences ..I may even feel brave enough to post!

I'm British too and have found this site so helpful and it has gotten us through some really confusing times! :o

I have used it loads over the last few years and you won't find a better place for information and support!

And you have been brave enough to post! :D
2nd April 2011 - married in MN, USA
7th April 2011 - Applied online for Spouse Visa
11th April 2011 - Spouse visa issued
12th May 2011 - Hubby home :)
22nd June 2013 - ILR :) :)

Tbh, I have so many questions, at the moment I wouldn't know where to start...but I have been looking at some of the relevant forums and found a few things that are helpful...and it's been a massive boost, knowing that plenty of couples are in the same boat!

Is he your spouse/boyfriend/or fiance? That helps to know which visa you want.  :) Unless you're going for school or work...
We met in Tokyo through friends when we both lived in Japan.

Last year we moved to Thailand, got our first apartment together, got jobs with the same employer (!), didn't end up killing each other, got married, and decided to move to the UK to settle down.

London, here we come!

Welcome to UKY...No worries on all the questions just make sure you post them in the right forum section to ensure the right people see them and can answer them.  I think 99% of the time they are answered very well and put a lot of peoples nerves at ease.

We decided to get engaged in February..but haven't made that official yet, as he had to leave a few days later, but plan to announce it to friends and family in June, when he's here again.
The plan is to marry in Dec,return to the states and then he will come back here and apply for IRL in spring of 2012. Though we may have a snag in regards to a very old civil judgement that he's getting legal advice with, but I wont clog up this thread with that.... :)
It really has been useful to read through some of the subjects..this is one hell of a strange situation and I was feeling a bit isolated. As thrilled as I am at having found the person I want to spend the rest of my life with...dealing with red tape on top of the separation can be a bit overwhelming at times. It's worth it though..I do know that!

Just a note to clarify: he won't qualify ILR until he has been living in the UK on a spousal visa for 2 years and he cannot apply for his spousal visa in the UK, he has to apply for it in the US after the wedding, but before he moves.

What he will need to do is either get a fiance visa, move to the UK, marry in the UK, stay in the UK and then apply for FLR(M), and after 2 years he can then apply for ILR. Or he will need to get a marriage visitor visa to marry in the UK, then return to the US, apply for a spousal visa, move to the UK and after 2 years he can apply for ILR. Alternatively, you could go to the US as a visitor, get married and then he can apply for a spousal visa and move to the UK (again ILR won't be for another 2 years after that).

I will second iLOvemarmitetoasts comment! We did it the hard way (with the fiancee visa and then marriage visa) It's an extremely long and EXPENSIVE route to go! We weren't sure what to do so we paid for a solicitor in London who told us to do it that way (our first mistake as they were just after getting the money working with us to do both visa processes! We only used them for the fiancee one though) then it was all craziness from there! Needless to say, in the matter of few months, after everything was said and done, we have blown right though our nicely padded savings plus lost like 3 months of time where I was hoping I would be working! Save yourself a lot of time and stress if you can!

Yes, reading back my post, I do realise he needs to return on the Spousal visa first, my brains so jammed at the moment, it has a habit of skipping ahead.
Nothing is set in stone yet, but I think we've decided that it would be easier, as we are against the clock timewise in December, to get married abroad (Cyprus). The US, would have been ideal, but as I have two children, who we wouldn't not want there on the day, it would just be too expensive to fly us all out.
At the moment, our greatest concern is the civil judgement...although it certainly has no baring on our decision to marry (regardless of the outcome, we want to be a family and that's that!) There's obviously a lot riding on that regarding where our future will be....We're just hoping for a positive outcome on that and the rest wont seem half as daunting.  :-\\\\

I can't give advice for the Civil Judgement, but I just got married this past november and had similar questions as to where to get married/which visa to get.

My husband and I looked at options for getting married elsewhere and then simply applying for a spouse visa to live here in the UK.  Just be careful and make sure you read ALL of the requirements.  Alot of them have specific days you need to be there in residence before you get married and may end up costing you more to do so, than if you just went with the fiance visa.

Since you stated looking at Cyprus, here's a link to the website I used to just get a feel for requirements.  Its always good to contact the appropriate people directly.

After looking at all of our choices, Going for the fiance visa, getting married here and then applying for the spouse visa was the best AND most economical choice for us.  Information about which visas to get depending on where you marry have already been given in previous posts by other members.
