Address for past-due FBARS, ask for waiver?
« on: May 31, 2011, 07:20:54 AM »
Does anyone know if you mail past-due FBARs to the same address you do regular FBARs? I stumbled across one website that said those have a different addy, but that's the only mention I've seen of this. Also, is there a certain individual or job title to whom I should address the accompanying letter?

I've got my three years of past-due forms ready and am working on my letter to accompany them. In the letter to the IRS, do you need to actually request a waiver of any and all penalties for late submission? I wasn't going to mention that, was just going to include the basic information (we didn't know we had to file an FBAR, we did file tax returns and list interest income, etc). But then I saw something on a forum stating you should ask for a waiver, it's the first time I'd seen that. Any ideas?

I'm sorry I've no advice but I'm about to write my letter out tonight for my 3 'late' submissions as well and why not ask for a waiver?

I'm definitely not using the words 'voluntary disclosure' in my letter.

Just take comfort in that you're not the only one in this situation...

The IRS explain at Question 17 here what they believe one should be doing until the end of August 2011:

Thanks for the commiseration! I have decided to use a phrase I found on one forum, which was to ask for a waiver of any and all penalties. And I won't use the words "voluntary disclosure," either; from what I've read that is what has caused problems for some people who didn't need to go the VD route.

This whole process sucks, wish they could at least let you know your forms arrived! I know, I can call after 90 days, at which point my 2010 forms will be late. I'm slipping into thoughts from my thread about using Airsure to post, lol. I'll send my three late ones via fedex and just hope that goes ok.
