Need Urgent Advice!! Re: Signing Tenancy Agreement

Ok, so my UKC hubby and I are relocating to Scotland after living here in the US for more than 7 years. He's already gone over, and started working and is looking for a place to rent so that I can follow over. Well he found a place last week, and he put a £200 deposit down to hold it. Since we are married, they wanted my name on the lease, and even had me scan a copy of my US passport to send to them. I didn't understand why they wanted my info as I'm not legally allowed to live in the UK yet, but I'm guessing its because we are married.

Now he gets a call today from them asking for a copy of my visa. And even hinted that if I don't have a visa, they aren't even going to let HIM sign the lease on his own! I have no idea what to do, as I can't get a damn visa UNTIL he has found a place for us to live! Is there anything we can do to fight this, or to explain the situation to them? He told them that I don't have a visa yet, but that he needed a place to live so that I could get the friggin visa.

Any advice is helpful at this point! I don't understand why they would prevent him from signing a lease because of my current lack of a visa! How should we explain this to them so that they understand I'm not trying to live there illegally?! And this is a great flat too, since they are pet friendly and in a good proximity to the train station.

I think you just have to tell them exactly what you wrote - that you don't have a visa yet, you are in the process of applying for one, and that you can provide them with a copy of it when you receive it.  There's not much more you can do!

As I said before in an earlier thread, they have the final say over a dual tennancy. There is no legal requirement that a married person has one. Your partner can sign a tennancy in just his name. It really doesn't matter.

If they won't budge on this you may want to find a different landlord. If they are being unreasonable about this, imagine all the other things they can be unreasonable about!
August 2008 - Tier 4 - Student Visa

Ok, so there is no legal need for both of us to sign the lease, as long the letting agency gives me permission to live there too. Your last statement hits on my thoughts exactly CG. If they are this incredibly unreasonable about his name only on the lease, then what else are we letting ourselves in for.   :-\\\\

He's waiting to hear back from them at the moment. They are still waiting for info from the background check company, so we'll see what they come back with. I do think he's explained to them that he has to have a place to live before I can get the visa. And that we have no problems supplying them with a copy of the visa once I have it.

It amazes me that they even want a copy of my visa. In the US, they don't care if you are here illegally as long as you pay the rent. My OH was never asked for a copy of his green card for proof of residency and he signed all our leases too. But what can you do, ya know...
