Applying for the Green Card here in the UK or back in the US?

I've just started doing my research about what it would take to get a green card for my husband. After living here in London for 4 years, I'd like him to experience life in MN.

I don't have a job waiting for me in MN and was planning on finding one once I get back. I was wondering if it's going to be better to apply for his green card once we're Stateside? Since then we'll have found an apartment and have proof of residence?

Does anyone have any experience with this?

I'm wondering the same thing so hopefully someone comes along and answers. I know that a green card takes forever to get (like 6 months to a year) but I'm pretty sure that he can come there and work on a visa and then file for green card status. My best friend's husband does not have his green card yet... but he is working.

The thing about moving back to the US is it seems really hard to move back (from what I've been told) because you'll need to prove you have a job, place to live, etc. But hopefully someone can confirm.  :-\\\\

If you want to apply for a Green Card in the US then as I understand it you have to go through the Adjustment of Status process - see http://britishexpats.com/wiki/Adjustment_of_Status . My reading of that is that you can only apply for a Green Card within the US for your husband if you aren't currently married, he comes in on a K1 visa and you get married. Otherwise you need to apply from outside the US. This can be done from London (see http://britishexpats.com/wiki/DCF_I-130_Filed_In_London ). It's currently taking about 8-10 months, apparently.

This isn't the best forum to get advice on though - try visajourney or britishexpats for better advice.

When we went back to the US, we did it from the UK. It took a while, close to 9 months, however we weren't in a rush. It was pretty great just to walk into the US with it already sorted out for him.

Can't remember anything about the process, but it was just like when we came to the UK and had to get sponsors, loads of paperwork etc etc...

This. You can't change his status from visitor to permanent resident while in the US. If you want to do it in the US, you will have to travel back on your own and he will wait in the UK until his application is processed. That could take over a year. It will be much faster and you won't have to separate if you apply through the Embassy in London. If you don't have a sponsor, your only choice would be to move back to the US without him, find a job, and apply from there. If you have a sponsor, then definitely do it from the UK.

I used diveintoamerica to get info for my husband's visa.
