If you come to the UK on a Spousal Visa, do you have to be in the UK for a certain number of days before you can apply for a provisional driver's license?

Not as far as I am aware - I believe you can apply for it at any time.

Good question because I think I had read somewhere that you have to wait for so long before you can apply. It maybe for EU people??

From the DVLA website -
if you have moved to GB having recently been a permanent resident in another state of the EC/EEA, you must be a resident in GB for 185 days in the 12 months before your application for a driving test and full licence.

No time period is mentioned for people coming from the US, but I've heard several other Americans were told to wait the 185 days.

But that's just for taking the actual driving test... and you can't take the test until after you have passed the theory test... but you have to get the provisional licence before you can do any of this.

I cannot see anything on the UK licencing website about having to be in the country for a certain length of time before you can apply for a provisional licence.

You may have to have been in the UK for 6 months before you can take the tests and get a full licence, but as far as I can see, you don't have to wait to get a provisional licence. After all, anyone can apply for a provisional licence, even if they aren't planning to drive in the UK (as it can be used as official ID while in the UK instead of a passport).

I think the time limit is for EEA people, because the UK test is easier than (say) the German test, so they don't want Europeans zooming over just to take the test.

You get a year on your US license, of course, but I think you can get your provisional any time.
