delay in getting FLR(M)?
« on: September 15, 2004, 01:48:35 PM »
I received a letter today stating that my application was valid but unfortunately they were unable to grant me approval  upon initial consideration. I came over on a fiance visa with no trouble getting it, there's plenty of time left on it, we got married last month and I applied right afterwards.

I haven't worked, haven't used public funds, I'm listed for council tax...

Has anyone run into this before? I thought mine would be straight forward since I came over on the fiance visa so most of the background info had been provided earlier. Now I'm really worried.  :\\\'(

I'm a bit confused.  ???  You applied for Further Leave to Remain but you still have a fiancee visa?  I thought you were supposed to get a spousal visa first then file for FLR.

Either I'm way confused or the rules have changed more than I'd thought they had since my FLR was approved.

OK, I just confused myself even more.  FLR is the spouse visa, right?

There is no reason given, and they asked me not to call or write regarding the application - that part sounds like a standardized letter.  In the rest of letter it says:

It is therefore being passed to other teams for further enquiries and/or more detailed consideration.

I am living in the UK at present, came over initally on the fiance visa which I'm now trying to convert to spousal so I can work. If it wasn't the FLR(M) I was supposed to apply for, then I'm even more confused than you are.

No, you're right missy--it's FLR you apply for when you're converting from fiancee' to spousal visa.  You'll apply for ILR after you've had you spousal visa/FLR for two years.

I'm keeping my fingers crossed for you!   ;)

My fingers are crossed too---and I think you have helped me decide when the time comes to apply in person...I don't think I can handle the waiting!

I'm a huge advocate of applying in person.  Between planning a wedding and making an international move, the last thing I needed was weeks of waiting to see if I'd get my visa!

I know it's not possible for everyone to apply in person...but if there's any way you can do it--DO IT!   ;D

I got one of those letters when I applied for FLR, Missy.  I expected one, though, as I was applying for an Unmarried Partner visa & my situation wasn't straightforward.  I'm very surprised that you've gotten one, given that you've come in on a fiancee visa & you're now married!

If it makes you feel better, I received my visa grant about a week after I got the letter saying it needed to be passed on for further consideration.

I have wracked my brain thinking which one of the things they want you to prove I might have messed up on...

no work, no public funds, we had a UK marriage license... I cannot think of what they might be looking into further. :/

I was hoping they did this on a random basis, like they do for following up on the people that certify your picture for a UK driver's license. But it seems that's not the case if no one else has had this while converting from fiance visa.

I'm just worried they'll send me back to the states, when I've moved my entire life over here - how scary. :(

Is it your 1st passport or a renewal?  Did you ever leave your passport someplace for a while or with somebody?

When did you apply for the FLR(M)?  My wife applied for hers in mid-August.  We got a letter back saying they'd recieved it etc.  Haven't heard anything since then.

This is my first US passport, no one should have had access to it without my knowlegde. I have 2 very old expired Canadian passports, and they should be safe in a lock box at my sisters.

Cunray, I mailed it off around the 8th of August, and got back the initial letter you did. Then heard nothing until this letter at roughly the 5 week mark.

I've heard nothing yet, just waiting and trying not to worry over it.

Hopefully your wife's will go smoother. :)
