US income only, but filing US taxes from UK on student visa
« on: January 12, 2012, 07:57:32 PM »
My husband and I are living in Northern Ireland on Tier 4 Student & Dependant visas, respectively. I have US-only income, up until September, and none after that. He has US-only income as well, but up to the present, because he is telecommuting from the job he's had in the US for the past 5 years. All of his money goes straight direct-deposit into his US bank account, which a family member is keeping track of for him. Does anyone know anything about filing taxes in this situation? Is there anything different that we'd need to note? Any advice/info would be much appreciated. Thanks!

Does your husband use his US bank account while he is in the UK - does he withdraw money from it?

He does occasionally use his US bank account in the UK, but I have a UK bank account in which my school funding is kept, which we use primarily.

Hi Kobraskill,
Any earnings while a student is taxable in the United States but may be excludable under article 20 of the US/UK tax treaty for the first year. You will need to prepare form 8833 to claim the exclusion. Your husband's earnings are taxable in the US but may be excludable if he qualifies. See form 2555 or publication 54 for details. I hope this helps.
