Bankrupcy?
« on: June 20, 2012, 09:18:58 AM »
Hi Everyone,
Ok, I searched on this topic but got a somewhat relevant thread that is a few old now.  Anyway, I am in a bit of a fix and could really use some advice. I am in the uk on a spousa resettlement visa.
I have a credit card issued by the US but I am having a really hard time keeping up with the payments.  Card has mainly attorney related charges from my divorce in the US (not purchases).   With no job here in the uK, a baby on the way, and high cost of living, DH and I have been trying our best to make payments on my cc but it is getting impossible to keep up with  :(.  I have been thinking about filing for bankrupcy in the US but I am not sure if this will affect my application for ILR in a few years  ??? . Any suggestions are much appreciated!

Have you tried calling the CC company and telling them your situation and then asking them to lower the payments to something more managable? It seems a like bankruptcy is a big solution to one cc that you are having trouble to pay off.

There are some good websites out there that will help guide you through  this process for free, it's worth a try anyway.

I would suggest you seek debt advice and work out plans to pay your debts at affordable rates.

For the UK:
http://www.direct.gov.uk/en/MoneyTaxAndBenefits/ManagingDebt/PlanYourWayOutOfDebt/DG_187500

And the US:
http://www.consumercredit.com/
I'm sure there are others.

There is mention of bankruptcy here in relation to impacting good character requirements regarding immigration matters:

http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/nationalityinstructions/nichapter18/ch18annexd?view=Binary

To seek UK Immigration advice:
http://oisc.homeoffice.gov.uk/

Best of luck with sorting it!  :)
