Need Urgent Help Moving and Working in The UK
« on: October 04, 2012, 06:38:07 PM »
Hi first off i would like to thank all who reply to this post but i am in need of help as i have never done anything like this before.

i would like to start off saying that i am a 20 yo US citizen and i have a Slovak girlfriend who lives and works in the UK i dont believe she is a UK citizen but just recently she has told me she was going to the doctor to recieve IVF which is basically trying to get pregnant because her testosterone and estrogen levels are off and she is unable to have a child. It was the day before she found out she was pregnant that she told me(3 days ago) it will not be my child but i am willing to call it mine. i have honestly no idea on the Visa i would need to at least set up temporary living in the UK i am currently studying for my Assossicates in Information technology and i have been looking for entry level jobs in the UK for Help Desk support but i want to be there for when she will give birth to the child. My whole thing is i do not wish to miss out on ANY of the childs life it will be 2 years before i have my Assosciates degree and i plan on taking my Bachelors degree in IT and become a information systems administrator. I am in dire need of feed back such as what are my possibilities what can i do as far as job wise and citizenship wise. i would like to hear any and everything anyone can offer to help me get a grasp on this my head is spinning i feel im not ready to be a daddy but i would do anything for this lady. I know a tier 2 visa and getting sponsored is quite a challenge but i would like if someone can point me in the right direction such as where to look for jobs that would possibly hire a entry level help desk support US person with an AAS.

Again i thank any and all replies and i am truly grateful for any input
 ???

Your chances of getting a Tier 2 visa for an entry level job are basically none. Why don't you marry your girlfriend?

Well i figured as much lets say if i were to get a entry level job in the US for now as help desk until i get my BA as a information systems administrator would i have a better chance of finding a job in the UK then?

And about marriage thing is she was married before and she was cheated on and is now going through a divorce i will say this it is not easy being with her i love her yet she has a hard time trusting me for i dont know what reason i give her no reason to not trust me she said she will marry me but im sure she is still unsure of what she wants.

You could do your degree in the UK.  That's basically your only option if you don't want to get married.  You can't qualify for a Tier 2 as an IT help desk worker or systems administrator.  There are plenty of people in the UK and EU who can do those jobs.

how would we be able to get married i thought it is very strict there
we would have to get a spouse visa?
she is having a kid who is not mine

what IT jobs are there available in the UK that would hire a US person?

or how about international transfers? would that also work?

You would have to get married in the US or a third country, then apply for an EEA Family Permit.

Tier 2 visas are only for highly skilled and experienced people.  It would take you many years of honing your skills before you'd stand much of a chance.  Anyone who wanted to sponsor you would have to prove that they couldn't find anyone else in the UK or EU who could do the job, so lower level jobs aren't going to qualify.

Inter-company transfers do happen, but again it would take years to reach the point where a company is going to go to the trouble of transferring you.

Intra-company transfers are possible, but you do have to work for a company for a minimum amount of time -- I believe it is a year -- to qualify.

Associates' level education won't land you a student visa, either -- you'd need to be on a course with a higher rating.

im sorry for all my questions

i am just now starting my AAS but the school i was talking with has told me that i should get out and look for a job in Help Desk immediately just to get experience in the IT field.

I was told that they stopped HSMP in 2011 is it still up?
would i be able to qualify for something like that lets say in 4 years?

my main goal is to get my BA in information techonology as a systems administrator or network administrator but if it comes down to it if by the time my 4 years is up and i have my degree would it be wise to pursue my Masters in the UK?

again im sorry im new to this whole thing and i dont want to be the father who is in and out of their childs life for the next 4 years while im at school.

There is no HSMP any more.

It is possible for you to pursue a master's degree in the UK but four years is a long time from now. A lot can happen to you, your girlfriend and her child in that time.

HSMP is gone, but without a degree or job experience you wouldn't have qualified anyway.  If you want to get a BA eventually, why not apply to do one in the UK?

well lets say i were to get my Assosciate degree and maintain good grades and all of that i would not know where to start to even apply for college in the UK could you possibly give me some options as what i can and would i be able to look for work in the UK as a student? And wouldnt the international student fees be more expensive since i am not a EU citizen? My focus is to be with my lady and to support the incoming child i mean its 9 months but i still have 2 years before i even get my assosciates and your right a lot can happen but she is a personal assistant and im not the type to leave a child all in her hands i will support her as much as i can as much as i can until i can finally live with her.

You'd need to have your associates degree and transcripts evaluated by NARIC to see their UK equivalents. Once that is done, you can use UCAS to apply for universities. Their site has more information.

The international student fees are very expensive and in order to get a student visa, you need to prove that you have it up front, all of it, plus living expenses. You

On a student visa you can take part time work, no more than 20 hours per week, so supporting your girlfriend is not likely unless you command a grand salary -- which entry level IT people, even with degrees, do not. Even in London.

Ahhh i see now well lets say in 6 months i have an entry level IT job and i still have another year and a half until i get my associates degree if i were to look for a job in the UK when i arrive will i still be looking for an entry level job even with a year and a half experience or so under my belt? And after i receive my associates will i be able to live and work in the UK such as under contract or a full time job? We may possibly even get married while i am in school there but like i said i am not a UK citizen and she is a Slovakian woman who is a personal assistant but has her work visa so i don't know if the brits will let us marry if we are both non citizens.

Also how much would you see the international student fees would be?
i believe my lady says she would have a place for me to stay at and we could live for the time being

Absolutely -- 18 months' experience is still very much entry level. Even if it were not, you still need a sponsor and that is where the plan very much falls down.

In order to sponsor you, a company has to meet one of the four following criteria:

the job has an annual salary of £150,000 or more; or
the job is on the shortage occupation list; or
your sponsor has completed a resident labour market test (or an exemption applies); or
if you are already here under Tier 2 (General) and you are applying extend your stay, you will working for the same sponsor in the same job.

IT positions at your level do not pay £150,000 or more (you'll be lucky to meet the £20,000 mark you need for the salary requirement).

They are not on the shortage list.

There are many IT specialists in the UK and even more in the EU, so it would be impossible to meet the labour market test and there is no exemption possible.

And you are not already here.

International student fees are anywhere from four to twenty-five thousand pounds a year according to the UK education council, so it depends on where you go to school. Based on anecdotes, the average I see is around ten thousand pounds per year.

And also i would i receive help on finding a permanent job from the UK university maybe? just thinking of all this as i write it out
