Trying to file online, will not let me without spouses ssn
« on: February 01, 2013, 02:54:27 PM »
I'm trying to file my taxes online this year (as I have done every year before moving to the UK) and it will not let me file without my spouse having a social security number. He does not have one and is not eligible for one. We are filing as Married: filing separately.

Is there any way to get around this?

I've always done my own taxes before and this is making me feel extremely stupid.

Note: my total income for 2012 was $5515.72 counting what I made while I was working in the UK.

I have a feeling you cannot file online if you are outside the US. I seem to recall that this was the case a couple of years ago, but I'm not sure if they have changed this now or not.

In the case of your spouse not having a SSN, you would usually put that he is a NRA (Non Resident Alien) in the box where it ask for his SSN - but if the online form will not let you do this, you may need to file the paper forms instead (or another option, I think, is to get him a ITIN number, but that might be too much of a hassle, especially if he did not live in the US last year and has no reason to file taxes himself).

The turbo tax one will let you file if you have a foreign address. How many different forms will I need to find/print out? We don't have a printer that works and DH's boss won't let him print anything for me at work.

There are some e-file companies that will let you do it, you just have to look around, making sure you use one that allows foreign addresses. Honestly though, I try every year and just give up, use the fillable pdf forms from the IRS website, and post them. It takes all of 10 minutes if you just need the 1040 and 2555-EZ (foreign income exclusion). Schedule B (for bank interest) adds another couple of minutes.

I cannot claim foreign income exclusion because I haven't been here a whole calendar year and I wasn't here for 11 months last year.  :-\\\\

I don't know the details, but you can change the timing of your filing so that you do qualify. Hopefully someone more knowledgeable will pipe up!

You can claim the foreign income exclusion under the physical presence test when you qualify. The return is not due until June 17th so there is plenty of time.

Paper file.
