2.6 When did you begin living together?
2.10 How often do you see (meet) your partner?
2.11 When did you last see your partner?
2.12 Are you and your partner related outside of your
relationship?
2.13 Have you lived with your partner permanently in the UK
since being granted temporary leave as a partner?
2.15 Were you married or in a civil partnership when you
were last granted leave in this capacity?
When and where did you marry/enter a civil partnership?
What type of ceremony was your wedding/civil partnership?

Hi,

I am not the original poster, but I was searching for an answer for 2.13 "Have you lived with your partner permanently in the UK since being granted temporary leave as a partner?"

I am applying for Indefinitely leave to remain and am presently in the UK on a UK Ancestry visa (which I've had renewed many times, having been here for more than 10 years).

The 2.13 question suggests the applicant must have 'temporary leave to remain' rather than be on a UK Ancestry visa.

Do you have any idea if I'm ineligible to apply using SET(M)?  I am a Canadian married to a British citizen.

I was keen to use SET(M) rather than SET(O) as SET(M) can utilise the checking service provided by the council.

(just to clarify this further, the UK Ancestry visa gives me residence permit which states "Limited Leave to Remain". Based on the SET(O) guidance notes, it says I can apply, however that seems to contradict question 2.13)

You can't use SET(M) unless you're applying as the spouse of a British citizen, and if you're doing that then you must first have been granted temporary leave to enter or remain based on that status (spouse visa or FLR(M)).  You could have switched from your ancestry visa to FLR(M) when you got married, but since you didn't do that you have to base your eligibility for ILR on the ancestry visa and not on your marital status.  So when you are eligible, which it sounds like you are now, you can apply using form SET(O).

Thank you very much for the quick and clear reply.  I really appreciate it.

I shall proceed with SET(O) - it's too bad they do not offer the checking service, as I know they can take months to process applications during which they retain my documents.  (But I know I can write to them if I really need to travel)

mother settlement uk visa

hi,
my mother she deported from uk in august 2008 as a visitor overstayer and took some medical treatments, i want to apply her settlement visa from pakistan, my mother she lives in pakistan with my sister about 5 years. please help me to give advice how can i apply that settltment visa outside uk. Is she has any ban 5 or 10 years to enter in uk. the settlement fee £1905 is too much and if she refuse visa is there any appeal right. please tell me is there any chance to get a visa indefinite leave to enter from pakistan.

It's very, very difficult to get a dependent-adult family member visa, particularly as your mother has a complicated immigration history AND ostensibly has other family who can support her in the country of her citizenship. Consult with an immigration lawyer; they'll probably tell you it's a no-go situation, but at least you'll know for sure, rather than spending money to find out from UKBA.
