The 185 days has always been there... I'm sure it doesn't apply to people on settlement visas but I don't know about Tier 2 holders... If I remember correctly it's about being 'ordinarily resident' in the UK. I think the idea was to prevent people coming to the UK (from the EU?) for a few months, purely to get a UK licence and then move back home again.

Good luck Becca!  I'm hoping for a positive report tomorrow.

Ksand, yes that's what I told her.  (That I thought as long as she would be a resident it would be okay).  Her visa is a Tier 2 ICT and she's from Russia.  She actually just wants it as an ID.  I guess we'll see if they reject her application or not (I'll let her expense the fee if it's rejected, hee hee).

I've been putting off getting online and booking an appointment to take the driving test. It's been 6 weeks since I passed the theory. Just being lazy. But my year is up the middle of April, so I better get my butt in gear.

Do.  Been a few years but I passed my theory test in August and I booked the first available practical test which was December - almost a 4 month wait.  Your mileage will vary depending on how busy the testing centers in your area are.

Just checking something.  I have a new employee at work and she's applying for her provisional license and the "resident for 185 days" in the application is throwing her for a loop.  I'm pretty sure she can apply even though she hasn't been here 6 months yet, just that she needs to be an ordinary resident of the UK (which is proven by her Tier 2 visa).  Is this correct? 

The granting of a licence and removal of a licence under the Road Traffic Act did get amemded in parts under the Immigration Act 2014, but it seems she will be ok unless she has a short, short term ICT visa.

in the case of an application that is made by virtue of section 97(2) (application for provisional licence), the applicant is lawfully resident in Great Britain and the Secretary of State is satisfied that the applicant will remain so for not less than 185 days; and
46 2 (c).
