There's no way for her to renew her US license without retaking the test - so it's not an option currently. We don't have much need to rent cars outside of the US, I'm an advocate of using more sustainable transport options when possible!

My Wife's supposed new employer is giving her the run-around. They clearly don't want her any more now that they have thought about the fact she's from the USA - as such they are purposely withholding information from her, I think in the hope that she will give up and look elsewhere for a job.

After a week and a half of being messed around and them not calling back when they said they would, she has eventually found out that now Head Office has decided she can't start until she has given them her NI number. I am only sending off the application form for the NI number today and it will be weeks before she has it. I also know that she can legally work in the UK without an NI number in this circumstance, as she is able to prove she has a legal right to work here, and the NI number application is underway. I double checked this advice given to me by the NI application phoneline here:

So my question is, can this global company stop her from working until she provides them with her NI number, or can she press her case with them that she can start asap? She has already provided her passport and BRP and has a signed contract from them.

I'm getting seriously pissed off with how my Wife has been treated by prospective employers, and now the company that has actually offered her a job is being crap too. Any assistance appreciated!

Hey gemology,

Sorry if I'm prying, but what state is she from that she can't renew her license after it's expired? I know I renewed my Colorado license late a few years ago, but I didn't have to retake the test. I can even renew my license online once or twice before I HAVE to go in and have it done at the Department of Motor Vehicles.

My understanding is that until she's been employed for a year, there's not much in the way of employee protections, unless she could prove discrimination. Are you sure they really don't want her though? Possibly this is just a fast food chain with high employee turnover being flaky with its employment procedures?

I suppose, what I'm really asking is:
Can this company prevent her from starting work until she has provided them with an NI number, when Government guidance states that an NI number is not necessary to commence employment?

As far as I know, it's up to the discretion of the private company as to whether they want someone to start work without an NIN. I know there are some places that won't give your application a second glance if you don't have one. While its not illegal to work without one, I don't think you necessarily have a right to work without one. Someone please come elaborate on this if you know more than I do.
