BRP Process--really confused!
« on: March 26, 2016, 07:08:23 PM »
Greetings everyone.

I have been in the UK (spouse of a UK resident) since July 2015 but I never received a BRP automatically as part of my visa or immigration application.

I did complete and receive biometric confirmation from the US when I submitted my initial spousal visa application before coming over, but I am hoping my BRP documentation happens in the UK in conjunction with the next phase of my immigration process (FLIR).

Any guidance would be greatly appreciated. I am feeling slightly panicked right now...  ???

Submitted spouse visa application on 28 March 2015
Valid until 20 January 2018

You're not supposed to have a BRP yet, so there's nothing to worry about :).

Before May 31st 2015, BRPs were only issued for visa applications made in the UK, and any visas applied for from outside the UK were issued as a sticker in your passport.

So, currently you will just have a visa sticker in your passport, and then in 2018, when you apply for your next visa, the FLR(M) will be issued as a BRP card.

Wow--I appreciate your quick response. I confess, the process is still pretty confusing for me. I am hoping it will become much more clear by the time I need to go to my next step, which is FLR.

Thanks so much!

On this topic my wife has ILR and her US passport is up for renewal this year. No BRP as before 2015 but biometrics were taken in the US in the expectation of receiving a card which never came. Does anyone know if we will need to pay to get the biometrics taken again?

So her ILR is a sticker in her passport and not a BRP?

If so, does she work?

Yes she had the vignette sticker. No she doesn't work. My understanding was that the biometrics are all done and paid for. Any help appreciated. Thanks

Biometrics have to be completed for every application you make, even citizenship, for two main reasons:
1) to get updated information
2) to confirm you are the same person applying for each visa

As she doesn't work, she can just apply for her new USA passport and carry both her expired passport and new passport whenever she travels.

However, if they change the rules, or if she decides to seek employment, she will need to apply for a Transfer of Conditions, which will give her a BRP card.  This costs a few hundred pounds and takes up to six months to process.
