HELP - Do I need an appendix 2?

Hi Guys I'm new here.

Got all my docs ready, im looking at appendix 2 and it seems there is no box to check for someone applying outside the uk where the spouse also lives outside the uk. My spouse lives with me in america and we're moving back together. Is there another form?

We are applying for a uk spouse visa! Do I just use appendix 2 and not check one of those boxes or is there a specific form for those applying outside the uk where the spouse is also.

There's only one Appendix 2, and it's the correct form - and yes, you MUST include it as your application will not be complete without it.

You tick the box to say you are joining your spouse in the UK... it's doesn't matter if they currently live outside the UK, as long as you are moving back together. For the purpose of the visa, your husband being a UK citizen means he is 'settled' in the UK.

So you tick: "As the spouse or civil partner of someone settled in the UK."

Thanks so much for your help it's all sent off now as of yesterday!


We applied using category a. From what I understand you have to be employed at time of application but now the application has been sent off I am thinking about having next Tuesday be my last day at work. This is ok right?

Are you the UK sponsor or the US applicant?

If you are the US applicant, your current income cannot be considered for the visa, so your job is completely irrelevant.

To qualify under Category A if you are currently both living in the US, the UK sponsor must meet the following 2 requirements:

1) they are currently employed on the date the online application is submitted/paid for and have been with that company, earning at least £18,600, for a minimum of 6 months
AND
- either the job will continue in the UK (remote working) or the UK sponsor has a guaranteed job offer in the UK which pays at least £18,600 and starts within 3 months of moving back

I'm the sponsor so from what you kindly posted it seems like I'm good as I was employed at time of online application and I have a job lined up in England paying above the threshold!

Yeah, I think you'll be okay.

If you had left the job before applying then you would need to qualify under Category B instead:

- UK job offer meeting same requirements as above
AND
- you have earned a total of £18,600 or more in the last 12 months

Just be cognizant about how long it may take to obtain the visa.  If you are okay to be without pay for an undetermined amount of time, go for it!
