The house is owned free and clear by the owner, no mortgage.

The 1444 is gross, but he's paid every four weeks, not every month.  But we can prove he makes the annual amount, and I can use that savings.  I will have to look into the cat B option.

It's peculiar they don't account for different pay periods, but I believe you.

I scanned in the refusal letter.  Can't help but laugh, they literally used newsprint and couldn't spare so much as a staple to hold it together.

LOL. It wasn't personal, pretty much most letters these days from government offices come on that paper. It's due to a sustainable procurement charter, and not 'let's do this as cheap as possible'. I've had other letters from both The Home Officr and other government departments printed on the same stock. 🌿🌎

You'll need to make a note of how he is paid in a very obvious place as they really are sticklers for that £1550 amount if using Category A.

My visa was originally denied as one of my husband's payslips was under the £1550 threshold, it was £1500. I wrote a very strongly worded email explaining what the reason was for the amount being short and how the next payslip had the shortfall on it. After a nerve-wracking day or two my visa was granted. I didnt have UKY at the time... this forum is SO helpful.
The usual. American girl meets British guy. They fall into like, then into love. Then there was the big decision. The American traveled across the pond to join the Brit. And life was never the same again.

Hi every one. I am new in this forum. It is so bad to know the refusal, when we all prepared and submit our visa application after months and months research in internate even taken a solicitor's advice and help to collect our document.
I also got my spouse visa refused.
I am an international student in australia original from nepal by birth. The reason ECO is not satisfy on E-ECP 2.1 and 2.3
Is there any one who's visa refused for these 2 point. Please help.

Refusal of Entry Clearance for spouse visa - next steps?
« Reply #19 on: October 13, 2016, 07:22:38 AM »
Sorry to hear that :(.

From what I can see, E-ECP 2.1 and 2.3 are about proving that your UK sponsor is:
- UK citizen
And
- over 18

So, for that you just need to include a certified copy of their UK passport photo page.

Can you start a new topic with the exact refusal letter wording? (Taking our personal information). So we can see exactly what they said for the refusal reason.

Yes i provided my sponsor's passport copy and visa page.
For 2.3 UK citizen or present in UK. What should i put in document. Becaues i put my husband's bank statements, which has his home address, landlord letter who said he's been living there and dont mind me to join him. Letter from employer said hi's been working in his company. His utility bill. His payslips which has his residentisl address.
What else document need to proof 2.3 ?

As I said, if you can post the refusal letter wording in a new topic, we can help you work out exactly why the visa was refused.

As far as I can see E-ECP 2.3 is just showing he is over 18... Which is shown by his passport.

Often the refusal letters can seem to be about one refusal reason but are actually something completely different. For example, the first poster in this thread thought their visa was refused for relationship evidence when the main reason was for financial evidence.

Ah, okay, they are saying that because he does not hold permanent residence in the UK (ILR), he cannot sponsor you for a visa.

What visa does he currently hold?

If he does not currently hold Indefinite Leave to Remain or UK citizenship, you cannot apply for a spousal/partner visa.

Okay, that's not ILR.

ILR is only issued from inside the UK after living in the UK for 5 years and is a separate plastic BRP ID card.

Also ILR is indefinite and never expires. The BRP card is valid 10 years, but that's just for updated personal info and a new photos. His visa is only valid for 9 years.

He has a temporary entry clearance visa, which I believe will be valid for the time that his father's contract in the forces is valid.

Therefore he does not qualify to sponsor you for a partner visa.
