I am trying to get a stamp 4 on my passport for Ireland,  which would give me permission to live there and get married within six months because I would be considered a "durable partner" and then apply through U.K. Embassy in Dublin for the priority spouse visa!

Everything I'm reading is that for the Stamp 4, you need to already be married.  But I am certainly no expert in Irish immigration!

Excuse my ignorance as I don't know much about Irish visas but don't you have to be married prior to getting a Stamp 4? That's what I'm reading anyway. Also, doesn't it have to be with an Irish citizen which you husband is not? Unless you are obtaining it through work - do you work in Ireland?

He is an Irish citizen as well as British, and we were going to try to prove that we have been in our relationship for 10 years to get the durable partner stamp. Down south you have to prove you've been in a relationship for 2 years.

Is it "just" a relationship or do you have to prove that you have been living together in a relationship "akin to marriage" for two years.  As to do that, you would have to have been living together legally in the same country together for the past two years (which time on a visitors visa doesn't count towards).

Again, this is all speculation, as I know NOTHING of Irish immigration law.  Just to qualify as an unmarried partner in the UK, you need two years continuous lawful residence with documentation (joint leases, utility bills, bank statements, etc.).

Let us know how you get on.  Based on the info you shared in your messages and all, I would recommend you work with an attorney.  I would just be sure to work with one who is excellent at US to UK situations and can help with sticky situations.

We usually recommend Medivisas in London (Victoria Sharkey is excellent) or Laura Devine.  She has offices in both London and NYC.  You don't need to be in London to use either, that's just where the offices are.

Feel free to sanity check anything with us though!  I just think you'll need that extra bit of help as not everything has been above the board to date.

Thank you! We have gone to 3 different lawyers who haven't given us the best info :(

I can't really provide much advice, but if you're trying to find a country where you can marry easily - look at Canada. UK friends of mine married there quite easily, and it doesn't require any special visa. Going to the US from there would be pretty easy for finishing the application. I love Toronto and Niagara Falls!

Hi guys, quick question.

Just went through the thread. I just arrived in the UK on a fiance visa, and I want to make sure I'm on the right track.

Once I get married, do I HAVE to apply for a spouse visa, or can I apply for LTR instead? Obviously my main reason would be to save money (I think the spouse visa will cost me the same as the fiance + £600 Health Surcharge?). Thanks!

If you want to stay in the UK, you'll need to apply for FLR(M).  Then you'll apply again in 30 months.  And again in 60 months (ILR).  Currently all in for all the visas is well in excess of £6k.  As the costs and fees increase substantially each year, I would budget £10k over the next 5 years for visas.

The spousal visa is only issued OUTSIDE the UK if you are already married before you apply, so it's not something you should be looking at applying for anyway.

What you need to apply for is FLR(M) (Further Leave to Remain - an LTR visa), which is valid for 30 months and costs £811 + £500 NHS surcharge.

The cost comparison:
Spousal visa = £1,795 (applied for in the US)
FLR(M) (LTR) = £1,311 (applied for in the UK)

Yes, it's the same financial requirement.

Once you have the FLR(M) visa you will be allowed to work, which means that you canc ombine your incomes to meet the financial requirement for the second FLR(M) visa (after 2.5 years) and ILR (5 years).

It's mostly the same, but for relationship evidence, instead of showing communication between you, you need to provide evidence of living together in the UK.

So, you'll want to get your names on bills and things ASAP and also make sure you get sent paper bills in the mail. DO NOT go paperless on anything.

You'll need 6 documents addressed to both of you at the same address (either jointly or separately), evenly spread over the time you've lived together (up to 2 years)... although if you've only just moved to the UK, you may not have 6 documents, in which case, you submit what you do have and explain why you don't have 6 each yet.
