No he isn't claiming any other form of benefts. I dont understand, it says if he isnt subject to immigration control he cant claim, he is not entitled to claim if he's a British citizen? We dont live in London, would they be able to handle our case from a different city?

The benefits Tax Credits and Child Benefit, are handled by HMRC (at present). It's nothing to do with the city you are in. Have you phoned the Tax Credit helpline and explanied this to them to get their stance on this?

This is so stressful. Would it be better to leave the UK with our daughter and apply? We obviously dont want to be separated again. My stomach is in knots. We ibviously dont want to continue to live off benefits we want to give our daughter the best life and thats by doing it the rignt way.

Unfortunately, overstaying was not a good idea, as I'm sure you realise now.

As an overstayer, you are not allowed to work, not allowed to use the NHS for free, not allowed to rent, nor have a bank account etc.

As you want to live in the UK eventually, then you need to get this sorted asap. You need legal advice as you do have options to get this sorted.

One thing we didn't ask, how long have you overstayed? Is it just a few days?

I meant to say this to Kfdancer, as she suggested to seek help from Medivisas cause they are based in London. Just asked if they could help us since we live in Sunderland but I seen on their website that they do over the phone consultations. I been here since April 2016 Sirius.

Both law firms that have been recommended will do phone consultations.

Oh that's a shame. That overstay will affect when you can be granted British citizenship.

Did you know that your partner can do more than one job to meet the financial requirement to sponsor? With the minimum wage rising to £7.50 for the age 25s and over this week, that is just under 48 hours a week if all he can only get is minimum wage. He would need to continue both those jobs until your partner/spouse visa is in hand.

Whatever you decide; to try to get the 10 years and four visas and four lots of the IHS to ILR by trying to use your British child, or to return to the UK on a partner visa, (or marry for a spouse visa) for 5 years to ILR; he should still sort out his Tax Credits claim. See what they say about you being there for a year and his single parent claim as I don't know how they will view that. UKVI shares information with HMRC and it is much better if he approaches HMRC (Tax Credits) before they approach him.

Get some health insurance too as the NHS can add 50% to the bill if there is no insurance. If you try for that 10 year route, it won't be a quick answer.
