returning resident denied

hey peoples, so my application for returning resident was denied which is fine...i was expecting it to be denied, and it was a risk we were financially willing to take.

but I am confused as to which visa i have to apply for now.

background info:
I married a British citizen in 2006, was granted my ILR in 2009. Had twins in 2010, they are dual citizens.
Moved out of the UK in 2014, and now wish to return back to settle with my husband and children again. They're fine, they have British passports. pplied for Returning Resident 2 weeks ago and it was denied.

the ukvisa website is telling me I need to apply for family visa.... That doesn't sound right.
Everything has changed since i last had to apply for anything in 2007. :/

You will need a spousal visa (family visa).

The RR is totally different to the spouse visa. RR would have meant a return to ILR (Indefinate Leave to Remain) which had expired because they were outside the UK for more than 2 years. . The spouse visa is starting again from scratch.

yeah it was because I returned for a visit after the 2 yr mark...the ECO wrote that everything would have been okay if I visited within the two years.

you applied for returning resident as well?

my husband and children have to be settled over there already for me to apply?

JennBomb, no we didn't apply for returning resident because we've been living in the US for three years. I too am married to a Brit and we have two children with British passports. We looked into RR but didn't qualify so we did family. First one was denied. They are absolute sticklers on finances and they even said we needed more proof that my husband would travel with me to the UK. As if I'd apply for a visa then ditch him in America! Total joke. We're on our second application. Just make sure you meet the financial requirements and prove your relationship.

No, you can travel at the same time. The wording is misleading.

Very sorry that it wasn't successful.  But it was a small price to pay on the off chance it was successful.  At least you'll always know you made the right choice with the spouse visa now!
